The purpose of this chapter is to establish minimum standards for housing, care and handling of animals to ensure the humane care and handling of animals, as well as provide for the health, safety, and welfare of surrounding properties and the public.
These development standards apply to animal boarding, animal shelters, and animal clinics herein referred to as "animal care facilities."
All animal care facilities shall, in addition to the other requirements of this title, comply with the following minimum standards. Failure to meet these standards shall be grounds to deny or revoke the animal care facilities permit.
A. 
Secure enclosure. Secure enclosures must be provided which allow adequate protection against weather extremes. All buildings housing animals must be adequately heated and ventilated.
B. 
Food and shelter. All animal quarters and runs are to be kept clean, dry and in sanitary condition on a daily basis. All food and water shall be free from contamination, wholesome, palatable and of sufficient quantity and nutritive value to meet the normal daily requirements for the conditions and size of the animal. All animals shall have fresh water available at all times.
C. 
Space requirement. Each animal shall have sufficient space to stand up, lie down and turn around without touching the sides or tops of runs. Facilities shall provide an adequate exercise area, or provisions for daily outdoor exercise off site.
D. 
Dogs may be kept outside in outdoor runs during the day but must be brought inside for the evening by close of business or 10:00 p.m.
E. 
Provisions must be included to mitigate barking dogs, including but not limited to bark collars, soundproofing the facility, or other acceptable methods to the Town.
F. 
Facilities must be heated and cooled when needed and well-ventilated to remove bad odors.
G. 
Facilities must have warm and cold water, and proper drainage system to handle sanitation requirements.
H. 
Sick animals shall be quarantined from healthy animals in a separate enclosure.
I. 
Animal care facilities may not directly abut residential zoning.
A. 
A fostering license may be issued to animal shelters who utilize a system of volunteers to care for companion animals in a volunteer's home for a temporary period.
B. 
The animal shelter shall maintain an up-to-date register of volunteers' homes where the number of companion animals will exceed four. The register shall include the animal shelter, and each volunteer's street and mailing address, contact name, telephone number and other contact information. It shall also include the expected number of animals per home not to exceed six at any given time.
C. 
The volunteer registry shall be kept up-to-date by the animal shelter and kept on file at the Animal Control and Planning and Zoning Departments.
D. 
Should a volunteer receive two or more citations from the Town in a two-year period due to issues with fostering animals, the volunteer shall be banned from the registry for a two-year period.
The following items shall be included in all applications for conditional use permits relating to animal care facilities:
A. 
Size of premises on which the kennel or confinement area is proposed to be located.
B. 
Maximum total number of animals to be kept on the premises at any time.
C. 
The expected mix of animals by species and gender at any time.
D. 
The type of enclosures, if any, including:
(1) 
Size of enclosure(s);
(2) 
Fencing type and height;
(3) 
Type and size of year-round shelters;
(4) 
Source and location of water supply;
(5) 
Sanitary maintenance, including provision for collection and disposal of excrement and other waste solution or material.
E. 
Landscaping and other visual and noise barriers (screening).
F. 
Surface drainage.
G. 
Expected weekly traffic related to the facility.
H. 
Hours of operation.
I. 
A site plan for the kennel and building shall be required including:
(1) 
Location to scale of all of the existing and proposed buildings on the premises;
(2) 
Location to scale of any fenced-in enclosures;
(3) 
Dimensions showing the distance of existing and proposed buildings from existing property boundaries;
(4) 
Location of the underground containers or facilities, including any water wells within the vicinity of the kennel on the premises.
J. 
Any other information related to the keeping of the animals as requested by the Planning and Zoning Commission.
