GENERAL REFERENCES

As used in this article, the following terms shall have the meanings indicated:
ANIMAL
Any and all types of animals both domesticated and wild, male and female, singular and plural.
PARK AND RECREATION AREA
All those areas of property which the Borough of Kenhorst has created and maintains for the recreational use of its citizens, including but not limited to boulevard dividers and triangular plots of grass maintained by the Borough of Kenhorst.
No person owning or having in his custody any animals shall permit the same to enter the parks and recreation areas of the Borough of Kenhorst. Such action is declared to be a nuisance and dangerous to the public health and safety.[1]

If the officer knows or with reasonable dispatch can gain knowledge of the identity of the owner or custodian of the animal or fowl, he will return it to the residence address. If there is no one at the address, he will leave a notice indicating where the owner or custodian may reclaim the property. He will then proceed to the nearest animal hospital or shelter which will accept the animal or fowl and leave it. He will then secure or cause to be secured and serve or have served a warrant of arrest on the owner or custodian for permitting the animal or fowl to go at large.
Any officer or designated person picking up an animal or fowl and after reasonable diligence is unable to find who owns or has custody of it will take it to the nearest animal hospital or shelter and leave it.
The owner or custodian who redeems an animal or fowl from an animal hospital or shelter will pay a board bill on a per diem basis in an amount previously agreed to between the Borough and the owner of the hospital or shelter but in no event shall such payment be less than $5 per day.
Any animal or fowl not redeemed within 24 hours will be disposed of in such manner as previously agreed upon between the Borough and owner of the animal hospital or shelter. The owner of the hospital or shelter is made an agent of the Borough for this purpose, and his actions in this regard are declared to be for a governmental purpose.
Nothing herein contained shall be construed to permit the running of dogs and cats at large. All dogs and cats shall be restrained at all times on adequate leashes not more than five feet in length.[2]

Any person or persons violating any of the provisions of this article shall be punishable as provided in Chapter 1, Article I, Enforcement; General Penalty, of this Code.

Every person owning or occupying any property shall be responsible for the sanitary maintenance of the premises on which any animals or pets are housed, maintained or kenneled.
The number of animals or pets housed or maintained within a structure, or upon any premises, shall be limited only to those animals or pets that can be adequately maintained in a clean and sanitary condition as determined by the appropriate Health Officer or employee of the Borough so designated for such purpose.
Animal shelters, or areas in which animals are maintained shall be permitted only as approved by the same Health Officer and/or official or employee of the Borough. Animal shelters shall be constructed in such manner so as not to create a health hazard or nuisance to the adjoining property owners.
All animal excreta shall be removed and disposed of at least one time each day.
Excess animal food shall not be allowed to accumulate in such manner so as to create a food source for bacteria, insects or rodents.
No person shall maintain, transport or carry any animal or pet in any eating, or drinking establishment, food manufacturing or food service facility, except trained service animals.

It shall be unlawful for any person to permit any dog or cat owned by him, or under his supervision or control, to run at large either upon the public streets, sidewalks, alleys, or property of the Borough, or upon the property of persons other than the owner of such dogs or cats.

Owners of leashed or unleashed animals shall be responsible immediately for the removal and disposal of fecal matter deposited by their animals anywhere in the Borough of Kenhorst.
Animal noise disturbances are prohibited as provided in § 303-4F of this Code.
