It shall be unlawful for any person, firm or corporation to start a fire, to cause a fire to continue burning or to dump any smoldering ashes or debris or other refuse which is already burning in the municipal landfill or on any other property which is owned by the Borough of Buena.

It shall be unlawful for any person, firm or corporation to burn any trash, refuse or other material of any kind in the Borough of Buena so as to cause the emission of any smoke, soot, noxious odors, fumes or gases in such place or manner as to be detrimental to any person or to the public, or to endanger the health, comfort and safety of any such person or of the public, or in such manner as to cause or have a tendency to cause injury or damage to property or business. The escape of such matter is declared to be a public nuisance and may be summarily abated by the Construction Code Official or by anyone whom he may designate for such purpose.

Any person, firm or corporation who shall be convicted of a violation of any of the provisions of this chapter shall be subject to such penalties as set forth in Chapter 1, General Provisions, Article III.
