Pursuant to the provisions of Section 8a(5) of the Stille-DeRossett-Hale
Single State Construction Code Act [Act 230, P.A. 1972, MCLA § 125.1508a(5)],
the State of Michigan Construction Code, as adopted by the Bureau
of Construction Codes of the State of Michigan, is hereby adopted
as the Building Code of the Village of Michiana, subject to the modifications
contained in this article and the provisions of Act 230 of P.A. 1972,
as amended from time to time.
A.
Section 114.3.1, Fee Schedule, of the 1987 Edition of the BOCA National
Building Code and all other portions of said code as they shall pertain
to permit fees are hereby deleted. In their place, the Village Council
shall, from time to time, adopt, amend and modify permit fees schedules
by resolution of the Village Council.[1]

B.
Section 117.4, Violation penalties. Any person who shall fail to
comply with any of the requirements thereof or who shall erect, construct,
alter or repair a building or structure in violation of an approved
plan or directive of the Building Inspector or of a permit or certificate
issued under the provisions of this code shall be guilty of a misdemeanor
punishable by a fine of not more than $200 the first day, $500 for
each succeeding day or by imprisonment not exceeding 90 days, or both
such fine and imprisonment. Each day that a violation continues shall
be deemed a separate offense.
A.
Pursuant to the provisions of Section 8b of the Stille-DeRossett-Hale
Single State Construction Code Act (Act 230, P.A. 1972, MCLA § 125.1508b),
as amended from time to time, the Building Inspector of the Village
of Michiana shall be responsible for the administration and enforcement
of said Act, including all inspections required thereunder (Building
Code).[1]
B.
Pursuant to the State Construction Code Act (Act 230 of P.A. 1972,
Compiled Laws 1948, § 125.1501 et seq., as amended), all
permits shall be issued within 10 days of date of application, provided
the Building Inspector determines said application conforms to all
ordinances and laws of the Village of Michiana, including building
codes and zoning regulations; the laws of the State of Michigan, including
the Soil Erosion and Sedimentation Control Act, Sand Dune Protection
Act and High Risk Erosion Act; and the laws and regulations of the
United States of America.

The Federal Emergency Management Agency (FEMA) Flood Insurance
Study (FIS) entitled, "The Flood Insurance Study for Berrien County,
All Jurisdictions," effective April 25, 2024, and the Flood Insurance
Rate Maps (FIRMs) panels contained on Index Panel 26021 CINDOB, effective
April 25, 2024, are adopted by reference for the purposes of administration
of the Michigan Construction Code, and declared to be a part of Section
1612.3 of the Michigan Building Code, and to provide the content of
the "Flood Hazards" section of Table R301.2(1) of the Michigan Residential
Code.
