The purpose of this article is to set forth the membership and
function of the various boards and agencies which serve the Township.
The Board of Supervisors of Leacock Township shall hear and
decide petitions for conditional uses specifically authorized in this
chapter. Decisions to grant or deny the petition shall be subject
to the following:
A. General criteria.
(1)
The proposed use shall comply with those criteria specifically listed in Article
XVIII of this chapter. In addition, the proposed use must comply with all other applicable regulations of the chapter.
B. Conditional use application. A conditional use application must include all the plan requirements listed in §
310-160 of this chapter.
C. Conditions. The Board of Supervisors, in approving conditional use
applications, may attach reasonable conditions considered necessary
to protect the public welfare and the purposes listed above, including
conditions which are more restrictive than those established for other
uses in the same zoning district. These conditions shall be enforceable
by the Zoning Officer, and failure to comply with such conditions
shall constitute a violation of this chapter and be subject to the
penalties described in this chapter.
D. Unless otherwise specified by the Board of Supervisors or by law,
a conditional use approval shall expire if the applicant fails to
obtain a zoning permit within one year from the date of authorization
thereof by the Board of Supervisors or by the court, if such conditional
use approval has been granted after an appeal. The Board of Supervisors,
upon written application and for reasonable cause shown, may extend
the approval for an additional period of up to one year.
E. Hearing procedures. Before voting on the approval of a conditional
use, the Board of Supervisors shall hold a public hearing thereon,
pursuant to public notice. The Board of Supervisors shall submit each
such application to the Township Planning Commission at least 30 days
prior to the hearing on such application to provide the Planning Commission
an opportunity to submit recommendations. If after any public hearing
held upon an application the proposed application is substantially
revised, the Board of Supervisors shall hold another public hearing,
pursuant to public notice, before proceeding to vote on the application.
