A. 
Office Created. There is hereby created in and for the City the office of Chief of the Fire Department.
B. 
Qualifications. The Chief of the Fire Department shall possess all of the qualifications prescribed for Councilmen.
C. 
Appointment — Term. The Chief of the Fire Department shall be appointed by the City Manager and shall serve at the pleasure of the City Manager.
D. 
Duties Generally. In addition to all duties and requirements imposed by ordinance and Statute, the Chief of the Fire Department shall perform such other duties as may be required of him/her by the City Manager or the City Council.

The Chief of the Fire Department or his/her designated representative shall be authorized to direct the Fire Department outside the City with personnel and equipment. The Chief or his/her designated representative shall further be authorized, when deemed necessary, to seek and receive aid from other departments and/or agencies. The level of said assistance provided by the Poplar Bluff Fire Department shall be determined by the needs of the Poplar Bluff Fire Department. No remuneration shall be made or received for such mutual-aid; however, should any response involve a hazardous material incident, "Spill Bill" Section 260.500(2) and Section 260.530, RSMo., shall apply. "Hazardous material" shall be any material deemed as such under regulations promulgated by the Environmental Protection Agency or the Department of Natural Resources.
