A. 
The Commission shall have the power to adopt rules, procedures and bylaws for its operation in accordance with other provisions of this Chapter and in accordance with rules, procedures and bylaws pertaining to City Government operation. The Commission shall act in an advisory capacity to the City Council, Planning and Zoning Commission and zoning administrator in carrying out activities required by City ordinances relating to the administration of this Chapter and shall have the following powers and duties:
1. 
To make recommendations to the Council concerning the acquisition of development rights, facade easements and the imposition of the restrictions and the negotiation of historical property contracts for the purposes of historic preservation;
2. 
To increase public awareness of the value of historic, architectural and cultural preservation by developing and participating in public information programs and by recommending the update of the preservation program;
3. 
To review and make recommendations on nominations of properties to the National Register of Historic Places;
4. 
To make recommendations to the Council concerning the utilization of grants from Federal and State agencies, private groups and individuals and the utilization of budgetary appropriations to promote the preservation of historic or architecturally significant structures in the City;
5. 
To promulgate standards for architectural review in accordance with guidelines established by the Secretary of the Interior;
6. 
To evaluate and comment upon decisions by other public agencies affecting the physical development and land use patterns in the City;
7. 
To recommend to the City Council that the City purchase an essential structure where private preservation is not feasible;
8. 
To recommend designation of historic landmarks and/or historic districts and maintain a register of such designation;
9. 
After historic districts and or landmarks are designated, to review:
a. 
Applications for building permits for historic landmarks or within a historic district and to make recommendations concerning such application to the Planning and Zoning Commission;
b. 
Proposed changes to buildings, structures, street furniture, City parks, civic areas, public facilities or environmental features of a historic landmark or within a historic district, reporting its recommendations to the Planning and Zoning Commission;
c. 
Applications for demolition permits to demolish buildings or structures within a historic district or designated as a historic landmark and to make recommendations concerning such applications to the Planning and Zoning Commission; and
d. 
Applications for conditional use permits for a historic landmark or within a historic district and to make recommendations concerning such requests to the Planning and Zoning Commission.
10. 
To initiate from time to time a comprehensive review of the provisions of this Chapter or any part thereof; and
11. 
To carry out other functions which may be designated by resolution or motion of the City Council.

In the name of the City and in order to effect the purposes of this Chapter, the Commission may, with the consent of the Mayor and Council, apply for any gift or grant of any property and any form of subvention and, subject to the consent of the Mayor and Council, may receive any such gift, grant or subvention and acquire by gift, purchase, grant, bequest, devise, lease or otherwise the fee, any lesser interest, development right, easement, including any scenic easement, covenant or other contractual right, including conveyances on conditions or with limitations or reversions in any property in the City. The Commission may, with the consent of the Mayor and Council, apply for, receive or expend any Federal, State or private grant, grant-in-aid, gift or bequest in furtherance of the general purposes of this Chapter and, with consent of the Mayor and Council, may, notwithstanding any provision of law or ordinance to the contrary, for the purpose of matching or qualifying for such a grant, grant-in-aid, gift or bequest, obligate the expenditure of funds which the Commission may have or has appropriated to it, whether or not the same is to be spent within the then-current municipal or fiscal year.
