For the purposes of this Article, "temporary vendor" is defined as a merchant selling merchandise (excluding the provision of services) and not located inside a permanent building or structure on private property. "Temporary vendor" shall not include "peddler" as that term is defined under Chapter 610 of this Code.

It shall be unlawful for any person to engage in, conduct or carry on or to permit to be engaged in, conducted or carried on, upon any premises in the City, temporary vendor operations without first having obtained a business license thereof. A copy of this license must be on display in full view of the public on the approved site.

The license fee for a temporary vendor is five hundred dollars ($500.00) per day.

No temporary vendor may occupy any part of any property within the City limits without first having obtained written consent of the property owner. Said consent must accompany the application for business license and a new consent shall be required each time a temporary vendor undertakes operations.

No license for a temporary vendor shall be issued until a site plan shall be submitted to and approved by the Building Inspector showing conformance with the requirements of the zoning ordinances and other City codes. A fee of seventy-five dollars ($75.00) shall be submitted with the site plan to cover inspection services. Such site plan and fee shall be required each time a temporary vendor undertakes operations.

Any person wishing to operate as a temporary vendor within the City limits must provide to the City an individual sales tax number issued by the State to the temporary vendor.

A business license may be issued to a temporary vendor for a specific vendor site for the period of time approval has been granted by the Building Inspector for such vendor site, not to exceed one (1) day during a calendar quarter. A "day" shall be defined as a normal business day, not to exceed twelve (12) hours from the start of vendor operations.
