The Planning and Zoning Commission shall consist of ten (10) appointed members, one (1) of whom shall be a City Councilperson appointed by a majority vote of the full City Council. The Mayor shall also be a member if the Mayor chooses to do so. The remaining nine (9) members shall be citizens of the City appointed by the Mayor with the approval of the City Council; two (2) members for a term of two (2) years, two (2) members for a term of three (3) years, and three (3) members for a term of four (4) years; and annually thereafter before the first of September the Mayor shall appoint two (2) members for a term of four (4) years to fill the term so expiring; except, however, every fourth year thereafter the Mayor shall appoint three (3) members for a term of four (4) years to fill the terms so expiring. The nine (9) citizen members shall be qualified voters and residents of the City for at least one (1) year immediately prior to the date of appointment. Two (2) citizen members shall be appointed from each ward of the City, and one (1) citizen member appointed at large. Members shall serve until a successor is appointed. All appointments to fill vacancies shall be for unexpired terms only. Members shall serve without pay or other compensation.

The Planning and Zoning Commission shall elect annually in September from among its members its own Chairman and Secretary, provided that the Chairman shall be elected from the nine (9) citizen members. The Commission shall meet on the third Thursday of each month unless otherwise set by the Chairman of the Commission and provide such rules and regulations, not inconsistent with the regulations of the City, for its own procedures and transactions as it may deem proper. Six (6) members of the Commission shall constitute a quorum for the transaction of business.

The Commission shall have such staff and may employ other technical assistance as it can within the limits of appropriations made available to it, or such staff as may be assigned from the City Departments by the City Administrator.

A. 
The Commission shall have the power and it shall be its duty to:

Act as a Zoning Commission in accordance with the provisions of present or future State zoning, enabling acts and City ordinances.
2. 
Make recommendations in connection with the execution and detailed interpretation of the 1995 Comprehensive Plan and recommend such changes and adjustments in the plan as may be deemed desirable from time to time. The Commission shall also make recommendations on such other matters as may be requested by the City Council or on any such matters relative to the welfare, housing appearance or beauty of the City or any portion thereof.
3. 
Prepare and recommend to the City Council rules controlling the subdivision of land.
4. 
Make recommendations regarding the approval or disapproval of plats for land subdivision. Such plats shall be referred to the City Planning Commission before the City Council takes any action and failure of the Commission to act within sixty (60) days shall be deemed an approval of the plat as submitted, except that the Commission, with the consent of the applicant for the approval, may extend the sixty (60) day period. The ground of disapproval of any plat by the Commission shall be made a matter of record.
5. 
Recommend legislation from time to time which may be desirable to further the purposes of City planning.
6. 
The Planning and Zoning Commission shall make its recommendations with due regard to the City's relation to neighboring territory and shall utilize the Master Plan for the general purpose of guiding and accomplishing a coordinated, adjusted and harmonious development of future needs, best promote health, safety, morals, order, convenience, prosperity and general welfare, as well as efficiency and economy in the process of development, including, among other things, the lessening of congestion in the streets; securing safety from fire, panic and other dangers; promoting health and the general welfare, concentration of population, water, sewage, schools, parks, and other public requirements. Zoning regulations shall be made with reasonable consideration among other things, to the character of the district and its peculiar suitability for particular uses, and with a view to conserving the values of building and encouraging the most appropriate use of land throughout the City of Park Hills.

Any member of the Planning and Zoning Commission except the City Administrator, Chairman of the Parks and Recreation Commission and City Councilperson may be removed by the City Council at any time after written reasons are presented and a public hearing.
