A. 
Except as provided in Subsection B of this section, no person shall consume any liquor, beer, wine or other alcoholic beverage while such person is on any public space, except those premises duly licensed for the sale and consumption of alcoholic beverages on the premises.
B. 
The Village Board of Trustees may, by resolution, temporarily suspend the applicability of Subsection A of this section, or any portion thereof, for a period of time and in relation to a designated geographic area within the Village of Chatham, upon such conditions and limitations that the Board of Trustees may, in its discretion, impose. Notwithstanding any language:contained in or omitted from such resolution, such resolution shall not suspend, or have the effect of suspending, the applicability of Subsection A of this section in relation to the consumption of alcoholic beverages in a motor vehicle, such as would constitute a violation of § 1227 of the New York Vehicle and Traffic Law.
A violation of this chapter shall constitute an offense punishable by a fine not exceeding $50 or by imprisonment for 10 days, or by both such fine and imprisonment, for the first offense and by a fine not exceeding $250 or by imprisonment in jail for 30 days, or by both such fine and imprisonment, for a second or subsequent offense.
