Adoption. The provisions of Chapter 125 of the Wisconsin Statutes, as now existing and as the same may hereafter be amended, are hereby adopted and made part of this article of the Town of Lawrence Code (the "Code") by reference. In the event a conflict exists between Chapter 125 of the Wisconsin Statutes and this article of the Code, Chapter 125 shall control.
The Town Board of the Town of Lawrence has the specific authority under § 125.10, Wis. Stats., and general authority under its village powers under § 60.22, Wis. Stats., to adopt this article.

A. 
The Clerk-Treasurer, or the Deputy Clerk in the Clerk-Treasurer's absence, may issue a license known as an "operator's license," which shall be granted pursuant to the Town's discretion and upon application in writing filed with the Town Clerk-Treasurer. An operator's license may be issued only to natural persons pursuant to Chapter 125 of the Wisconsin Statutes.
B. 
No permit or license shall be issued or reissued to an applicant for a place of business that is nonoperational unless authorized by the Town Board.
C. 
All alcohol licenses and permits issued shall be pursuant to Ch. 125, Wis. Stats.
A permit or license which has been granted and issued but not in continuous use in a manner indicating an ongoing business for a period in excess of 180 days is presumed invalid and shall be subject to revocation unless authorized by the Town Board.

A permit or license issued may be revoked or suspended by the Town Board of Supervisors on any violation under Ch. 125, Wis. Stats.
B. 
No permit or license for an ongoing business shall be revoked or suspended by the Town Board without first affording the license holder an opportunity for a public evidentiary hearing at a regular Town Board meeting.
C. 
The Town Clerk/Treasurer shall notify in writing the permit or license holder upon revocation of a license or permit.

A provisional retail liquor license may be issued by the Town Clerk/Treasurer to a person who has applied for a Class "A," Class "B," "Class A," "Class B" or "Class C" license and authorizes only the activities that the type of retail license applied for authorizes. Section 125.185, Wis. Stats., is incorporated herein in its entirety, including any future amendments thereto.

Except as otherwise specifically provided in this article, all provisions of Chapter 125 of the Wisconsin Statutes, as the same may hereafter be amended from time to time, including but not limited to those provisions describing and defining regulations with respect to underage and intoxicated persons, their presence on licensed premises, possession and proof of age, are hereby adopted and by reference made a part of this article as if fully set forth therein. Any act required to be performed or which is prohibited by Chapter 125 of the Wisconsin Statutes is required or prohibited by this article. The penalty for violation of any provision of this article shall be imposed as provided in Chapter 125 of the Wisconsin Statutes, with the exception that imprisonment shall not be ordered.
