Former Ch. 10, Educational Service Agency, adopted 6-10-1980 by Ord. No.
343, was repealed 11-11-2008 by Ord. No. 2008-09, approved 11-11-2008.
The Council for the Borough of West Conshohocken, Montgomery
County, Pennsylvania, does hereby create the Borough of West Conshohocken
Shade Tree Commission.
The purpose of the Shade Tree Commission is to promote the beautification
of public spaces and encourage well-designed planting and landscaping
of private spaces in the Borough. In addition, the Commission will
strive to:

Provide a source of expertise available to residents for private
planting and landscaping activities and that assists the Borough in
its review of proposed land developments.
B.Â
Encourage public/private partnerships in tree planting and similar
Borough beautification activities.
C.Â
Encourage volunteerism among interested citizens.
A.Â
The Commission shall be composed of three members, all of whom shall
reside within the Borough of West Conshohocken, and who shall be appointed
by the Council for the Borough of West Conshohocken.
B.Â
As first established, the Council for the Borough of West Conshohocken
shall appoint to the Commission one member to serve for a term of
two years, one member to serve for a term of three years and one member
to serve for a term of four years. All initial terms shall continue
until December 31 of the year the term expires.
C.Â
On the expiration of the term of any member, a successor shall be
appointed by the Council for the Borough of West Conshohocken to serve
a term of four years.
D.Â
Vacancies in the Shade Tree Commission shall be filled by the Council
for the Borough of West Conshohocken for the unexpired term.
A.Â
The Commission shall elect its own Chairperson and Vice Chairperson.
Officers shall serve annual terms and may succeed themselves.
B.Â
The Commission shall annually report in full its activities, transactions,
expenses and related activities for the last fiscal year of the Borough.
This report shall be submitted to the Council for the Borough of West
Conshohocken for review and approval.
The Shade Tree Commission shall meet from time to time as members
determine to be necessary, such meetings being duly advertised and
open to the public. The Commission shall meet at least once a year
to reorganize.
The order of business at meetings shall be:

The Commission shall have the responsibility to plan and make recommendations
for the planting, replacement, removal, protection and needed maintenance
of shade trees on public roads and in public spaces in the Borough
and to make similar recommendations for planting and landscaping of
land developments in accordance with the Subdivision and Land Development
Ordinance.[1] All plans and recommendations of the Commission shall
be submitted to the Council for the Borough of West Conshohocken for
review and approval.
B.Â
Installation, maintenance, replacement or removal of all new and
existing planting provided as part of land development or provided
in public areas shall meet all applicable standards of the Subdivision
and Land Development Ordinance. The Commission may recommend that
the owner(s) of property be required to remove trees or parts thereof
that, because of disease or a similar adverse condition, threaten
to injure or destroy shade trees in a public right-of-way or other
public space.

Whenever the Commission formally recommends that the Borough plant,
transplant, remove or prune shade trees on any street or public area,
notice of the work proposed shall be announced at a Council meeting.
The announcement shall specify in detail the public streets or public
areas upon which the proposed action will occur.
The failure of the Borough to enforce any provision of this
chapter shall not constitute a waiver by the Borough of its rights
of future enforcement hereunder.
Nothing in this chapter shall be construed to affect any suit
or proceeding pending in court or any rights acquired or liabilities
under the ordinances of the Borough prior to the enactment of this
chapter.
The Council for the Borough of West Conshohocken, through this
chapter, intends to amend all other Borough ordinances or resolutions
or parts thereof insofar as they are inconsistent with this chapter.
