It shall be unlawful for any person, except when otherwise provided in contract ordinances, in which case the provisions of the same shall control, to excavate in or under any right-of-way, street, highway, boulevard, avenue, roadway, sidewalk, alley or any other public thoroughfare without first having obtained a permit from the City. The Director of Planning and Development shall consider all applications for permits of such nature and shall issue same if in his/her opinion the party applying therefore has complied with all the provisions of this Code or other ordinances and regulations of the City relating thereto and if, in his/her opinion, the excavation is necessary. A City representative shall inspect all such excavations as often as necessary. After earth and ballast have been replaced in the manner provided by Section 505.520 by the person making an excavation under this Article, the City shall reconstruct the excavation.

Each application for a permit for the purpose of setting poles on any street, highway, boulevard, roadway, avenue, sidewalk, alley or other public thoroughfare shall give the location of each of such poles and each of such permits shall include as many poles as are included in the application.

The Director of Planning and Development shall collect for the granting of all permits under this Article a fee in accordance with the fee schedule on file in City Hall.

In making an excavation in streets, alleys or sidewalks for laying service pipes or making repairs or for any other purpose, the material excavated shall be removed from the site in a manner least likely to inconvenience the public and so as to provide for the passage of water along the gutters. Street, alley and sidewalk excavations shall be repaired with the same type of material as existed previously to the excavation. Concrete streets, alley and sidewalks shall have total slab replacement. Asphalt street and alley excavations shall be filled with one (1) inch minus rock compacted, six (6) inches of concrete and two (2) inches of asphalt overlay. All excavations must be replaced to the satisfaction of the Public Works Official. All excavations must be replaced within one (1) week unless otherwise approved by the City. The permittee for the excavation shall be liable for any or all damages resulting from the excavation.

Whoever shall, in this City, dig or cause to be dug, any excavation adjacent to and bordering on any highway, thoroughfare or public place, shall, during the night, cause same to be protected properly and shall cause a red light to be kept burning thereon during the night. Whoever shall dig or cause to be dug in any highway, thoroughfare or sidewalk a vault shall arch or cover same over and secure the grating or covering of the opening thereof in such manner as to prevent persons, animals and vehicles from falling therein.

If any of the duties imposed upon the Director of Planning and Development by this Article have been conferred upon the Building Official by any provision of this Code, then such latter provisions shall control over the provisions of this Article.
