A certain document, three copies of which are on file in the offices of the Code Enforcement Department of Fallowfield Township, being marked and designated as the International Property Maintenance Code, 2015 edition, as published by the International Code Council, be and is hereby adopted as the Property Maintenance Code of Fallowfield Township in the Commonwealth of Pennsylvania for regulating and governing the conditions and maintenance of all property, buildings and structures, by providing the standards for supplied utilities and facilities, and other physical things and conditions essential to ensure that structures are safe, sanitary and fit for human occupation and use; and the condemnation of buildings and structures unfit for human occupancy and use, and the demolition of such existing structures as herein provided; providing for the issuance of permits and collection of fees therefor, and each and all of the regulations, provisions, penalties, conditions and terms of said Property Maintenance Code on file in the office of the Code Enforcement Department are hereby referred to, adopted, and made a part hereof, as if fully set out in this chapter, with the additions, insertions and deletions, and changes, if any, as prescribed in § 278-2 of this chapter.
A. 
The following sections of the 2015 edition of the International Property Maintenance Code are hereby revised as follows:
(1) 
Section 101.1, insert: Fallowfield Township.
(2) 
Section 103.5: delete.
(3) 
Section 106.4, insert:
Violation penalties. Any person who shall violate a provision of this Code, or fail to comply therewith, or with any of the requirements thereof, shall be prosecuted within the limits provided by state or local laws, and, upon conviction thereof, may be fined not less than $300 nor more than $1,000, or, in default of payment thereof, may be confined in the Washington County Correctional Facility for a period not to exceed 90 days. Each day that a violation continues after due notice has been served in accordance with this section shall be deemed a separate offense and may be punishable by per diem penalty as provided hereunder.

Section 112.4, insert: $300; $1,000.
(5) 
Section 302.4, insert: six inches.

Section 304.14, insert: May 1; October 1.

Section 602.3, insert: September 1; April 30.

Ordinance No. 156 of Fallowfield Township, adopting and implementing the 1996 Edition of the BOCA National Property Maintenance Code, is hereby repealed, rescinded, and is declared void in its entirety. In addition, any and all other prior ordinances or parts of ordinances in conflict with the terms and conditions of this chapter are hereby repealed to the extent of such irreconcilable conflict. It is the stated intention of the Board of Supervisors of Fallowfield Township that this chapter implement the 2015 edition of the International Property Maintenance Code as the only applicable property maintenance code regulations for Fallowfield Township, and that all prior adoptions of the Property Maintenance Code regulations be repealed by the terms and conditions of this chapter.[1]

Nothing in this chapter or in the Property Maintenance Code hereby adopted shall be construed to affect any suit or proceeding pending in any court, or any rights acquired or liability incurred, or any cause or causes of action acquired or existing under any act or ordinance repealed by this chapter; nor shall any just or legal right or remedy of any character be lost, impaired or affected by the implementation and adoption of this chapter.
