The Board of Supervisors of the Township of Fallowfield hereby reestablishes the streetlighting districts previously established in Van Voohris, under Ordinance No. 63 of 1966, and in Wertz Way, under Resolution No. 144 of 1982. The Board hereby reestablishes the lighting districts as outlined herein, in accordance with the terms and conditions of 53 P.S. § 67002.
The Board of Supervisors and the Township Secretary are hereby authorized and empowered to execute such agreements with electrical service providers as necessary to accomplish the illumination of the streets and public places within the established streetlighting districts. Further, any agreements presently in place as executed by and between the Township of Fallowfield and any electrical service providers are hereby affirmed, ratified and confirmed.
The Board of Supervisors of the Township of Fallowfield hereby established an annual assessment upon each property benefited within each streetlighting district, in accordance with the terms and conditions of 53 P.S. § 67003(a)(3). The Township Secretary is directed to compute the annual assessment for each property benefited by the illumination of the streetlighting district in accordance with the formulas and practices presently utilized by the Township. The assessment for each property shall be computed by dividing the total number of benefitted properties in each district into the total annual cost of the lighting in each respective district for the calendar year prior to the determination of the assessment.
The Township Secretary is directed to provide the annual assessment figures for each property benefitted in the streetlighting districts to the Township Tax Collector, in accordance with 53 P.S. § 67003(e). The Township Tax Collector is duly empowered and directed to bill such assessment on the annual real estate tax bill for general Township purposes for each benefitted parcel, together with such commission and expenses as provided under 53 P.S. § 68301(a) and as permitted by law for collection of the same. The assessments established hereunder shall become effective beginning with the January 2004 real estate tax bills, and shall continue for each annual tax bill thereafter, unless amended by subsequent ordinance of the Township.
All assessments when collected by the Tax Collector shall be paid over to the Township Treasurer, who shall receive and keep same in a separate account and shall pay out such sums necessary to meet the expenses as billed by the electric utility service providers, and upon direction by the Board of Supervisors of the Township of Fallowfield. The Treasurer is further authorized to make reimbursements from such accounts when any such expenses for the electric service providers are paid from the Township general fund.
