The Town Board, and any other board or officer of the Town of
Amenia that is authorized to solicit bids and award purchase contracts,
shall have the authority to award purchase contracts, which are required
to be awarded by public bid in accordance with § 103 of
the General Municipal Law, including contracts for service work, on
the basis of best value, as that term is defined in § 163
of the State Finance Law, to responsive and responsible bidders in
the manner provided by § 103 of the General Municipal Law.
All purchase and service contracts awarded based on best value
shall contain a statement in the notice to bidders and in the contract
specifications indicating that the Town has the authority to award
the contract based on best value.
As used in this article, the following terms shall have the
meanings indicated:
BEST VALUE
Shall have the same meaning as that contained in § 163,
Subdivision 1j, of the State Finance Law, to wit, the basis for awarding
contracts for services to the bidders which optimizes quality, cost
and efficiency among responsive and responsible bidders. Such basis
shall reflect, wherever possible, objective and quantifiable analysis.
Such basis may also identify a quantitative factor for bidders who
are small businesses or certified minority- or women-owned businesses
to be used in evaluation of offers for awarding contracts for services.
The Town Board will direct staff to identify appropriate evaluative
criteria and contract award methodologies for general use in awarding
purchase contracts by the best value method.
