Article 1 General Provisions

§ 500-1201 Purpose.

The purpose of the Conservancy District is to provide adequate natural areas for the drainage of surface and storm waters, and to protect and promote the general health, safety and welfare of the community and protect natural resource areas containing swamp, wildlife habitat and natural water or drainage courses.

§ 500-1202 Principal uses for Conservancy District.

A. In general. Table 12-1 lists all permitted and conditional uses allowed in the Conservancy District.

B. Permitted uses. Uses specified with a "P" are permitted in the district or districts where designated, provided that the use complies with all other applicable provisions of this chapter.

C. Conditional uses. Uses specified with a "C" are allowed as a conditional use in the district or districts where designated, provided that the use complies with all other applicable provisions of this chapter.

D. Prohibited uses. Any use not listed as either "P" (permitted) or "C" (conditional) in a particular district or any use not determined by the Community Development Director or his/her designee to be substantially similar to a use listed as permitted or conditional shall be prohibited in that district. Such determination shall be made in the manner provided for in Chapter 500-200, Administration and Enforcement, governing determination of substantially similar uses.

E. Specific development standards. Permitted and conditional uses specified with an "x" under the Specific Development Standards column shall be subject to the standards identified in other areas of the Village of Bellevue Zoning Ordinance.

§ 500-1203 Other requirements.

A. Any use allowed in the C-1 District shall meet the regulations of this district and all other applicable regulations as determined by the Community Development Director or his/her designee.

§ 500-1204 Warning and disclaimer of liability.

A. The degrees of flood protection intended to be provided by this chapter is considered reasonable for normal water or flooding levels. This chapter does not imply that areas adjacent to district boundaries or uses permitted within such a district will always be free from flooding or water damage. Nor shall this chapter create liability on the part of the Village or any official or employee thereof for any flood or water damages that may result from reliance or compliance with this chapter.
