This chapter, pursuant to § 187 of the General Municipal Law and also pursuant to Article 9, Permissive Referendum, of the Village Law, shall authorize and regulate the conduct of games of chance in the Village of Whitesboro.
The Village hereby authorizes the Town of Whitestown to be the licensing agency and enforcement agency for the Village.
This chapter shall be subject to a permissive referendum, and all notices pursuant to § 9-900 of Article 9 of the Village Law shall be posted and published pursuant to said law.
This chapter authorizing and regulating the conduct of games of chance in the Village of Whitesboro shall take effect after 30 days from today's date unless a proper referendum on petition signed and acknowledged by the appropriate number of Village residents is filed prior to that time calling for a mandatory referendum concerning the subject of this chapter.
Sunday sales shall be permitted except on Easter Sunday. No sales shall be allowed on Christmas Day or New Year's Eve.
Games of chance allowed under this chapter shall include only the games known as "bell jars" and shall not include games known as "merchandise wheels" nor shall it include any other type of games.
If no petition calling for a referendum is filed within 30 days, the Village Clerk shall again post and publish thereafter a notice stating that this chapter is fully effective and valid upon filing with the Secretary of State.
