A.
Pursuant to § 62.15(1), Wis. Stats., the
Common Council does hereby designate the following as classes of public
construction which may be done directly by the City, without submitting
the same for bids:
(1)
Construct and/or replace water mains.
(2)
Construct and/or replace water distribution (service)
lines.
(3)
Construct park shelters.
(4)
Construct retaining walls.
(5)
Construct sidewalks.
(6)
Construct curb and gutter.
(7)
Construct and/or replace stormwater sewer systems.
(8)
Construct and/or replace wastewater treatment mains
and services.
(9)
Construct stormwater retention basins.
(10)
Construct overhead electrical lines and install associated
equipment.
(11)
Construct underground electrical distribution lines
and install associated equipment.
(12)
Construct recreational trails.
(13)
Assist in street reconstruction.
B.
Pursuant to said statute, the Common Council does
hereby provide that any of the above classes of public construction
or any part of any such class may be done directly by the City without
submitting the same for bids.
A.
Limitation on contracts. Except in the situations described in Subsection B of this section, prior to entering into any contract for the construction of any public works project whose estimated costs exceed $5,000,000, the Common Council shall submit to the electorate a referendum for approval of the public works project. Failure of the referendum shall preclude the City from proceeding with the project. The wording of any referendum shall describe the specific purpose, location and estimated cost of the public works project.
B.
Exceptions. The restriction in this section shall
not apply to the following:
(1)
A project that needs to be undertaken due to an emergency,
as determined by the Common Council;
(2)
Any public works project to be undertaken under the
project plan of a tax incremental district within the City, pursuant
to § 66.1105, Wis. Stats.;
(3)
Any public works project to be undertaken under the
operating plan of a business improvement district within the City,
pursuant to § 66.1109, Wis. Stats.; and
(4)
Any public works project which the City is required
to undertake by order or other directive of any regulatory agency.
C.
Planning or design not restricted. Nothing in this
section shall be construed to preclude or limit the City from exercising
its role in the planning or design of any such public works project.
