There is hereby established within the City of Hometown a public library and reading room for the use and benefit of the inhabitants of said City. The use and maintenance of said public library shall be governed by the provisions of Local Library Act, Chapter 75 of the Illinois Compiled Statutes.
The Mayor, with the approval of the City Council, shall appoint a board of nine directors from City residents. Not more than one member of the City Council shall be at any time a member of said board.
Said directors shall hold office for three years. The Mayor shall, before the first of July of each year, appoint as before three directors, to take the place of the retiring directors, who shall hold office for three years, and until their successors are appointed. The Mayor may, by and with the consent of the City Council, remove any director for misconduct or neglect of duty.
Any person who fails to return any book belonging to the Hometown public library, or any of its branches, after the due date, according to the rules and regulations duly made and adopted by the directors of such library for the government thereof, shall be fined not less than $20 nor more than $750 for each offense.

(A) 
Any person who shall willfully or maliciously cut, write upon, injure, deface, tear or destroy any books, newspaper, plate, picture, engraving or other thing of value belonging to the Hometown public library, or any of its branches, shall be fined not less than $20 nor more than $750 for every such offense.
(B) 
Any person who shall willfully or maliciously commit any injury upon or to the Hometown public library, or upon or to the grounds, buildings, furniture, fixtures, or other property thereof, shall be fined not less than $20 nor more than $750 for each offense.

When any person has violated the terms of § 2.304, the officer or persons making the arrest may issue, in lieu of a formal complaint, a notice to appear at the police station in the City of Hometown within 10 days after said arrest with the books and pay the minimum fine of $20 for each offense. If the books are not returned he shall pay for the value of such books plus the minimum fine of $20. Every person issued such a notification of violation, after consenting to a waiver of court hearing and trial, may pay the sums for the violation at the police station, Hometown, Illinois, in lieu of said person's appearance in court. If a second notice to appear is issued, an additional sum of double the amount shall be added to the fines herein provided. Failure to pay the fine herein provided within the time provided shall subject said person to whom the notification was given to an issuance of a warrant for his arrest, and the police officer or person issuing such notification shall swear out a complaint for the arrest.
All monies collected for fines shall be turned over by the City Treasurer to the Board of Library Directors of the City of Hometown, to be used for library purposes.
Nothing in this article shall prevent the library from recovering the value of the books, where the books have not been returned.
