A.
There is hereby established a Building Department within the Incorporated
Village of Bayville, which is hereby designated as the Department
to administer and secure compliance with and enforce the New York
State Uniform Fire Prevention and Building Code ("New York State Uniform
Code"), and the Code of the Incorporated Village of Bayville, within
the Village, and which shall be supervised by the Superintendent of
Building Department as defined below.
B.
There is hereby designated in the Incorporated Village of Bayville
a public official to be known as the Superintendent of Building Department
who shall be a code enforcement officer and who shall be appointed
by the Mayor with the approval of the Board of Trustees, with a compensation
to be fixed by it, the Superintendent of Building Department shall
possess at a minimum the qualifications required of a code enforcement
officer under the New York State Uniform Code.
C.
Except as otherwise specifically provided by law, rule or regulation
or except as otherwise provided herein, the Superintendent of Building
Department shall be charged with the duty of administering, securing
compliance with and enforcing all provisions of the New York State
Uniform Code, the Code of the Incorporated Village of Bayville and
all laws, rules and regulations applicable to housing, building, construction,
alteration, repair, property maintenance, removal and demolition of
buildings and structures, including plumbing, drainage work and the
installation and use of materials and equipment therein and the location,
use and maintenance thereof and related matters and securing compliance
therewith. In the absence of the Building Inspector, the Superintendent
of Building Department may act on behalf of the Building Inspector
and the Superintendent of Building Department may exercise all of
the powers conferred upon the Building Inspector in the Code of the
Incorporated Village of Bayville.
If a court determines that any clause, sentence, paragraph,
subdivision, or part of this chapter or the application thereof to
any person, firm or corporation, or circumstance is invalid or unconstitutional,
the court's order or judgment shall not affect, impair, or invalidate
the remainder of this chapter, but shall be confined in its operation
to the clause, sentence, paragraph, subdivision, or part of this chapter
or in its application to the person, individual, firm or corporation,
or circumstance, directly involved in the controversy in which such
judgment or order shall be rendered.
