Darby Fire Company No. 1 and Darby Fire Company No. 2, organized and existing in the Borough of Darby, Delaware County, Pennsylvania, are hereby designated the officially recognized fire companies of the Borough.
A. 
The fire companies recognized by the Borough are hereby authorized to provide such services to the Borough as may be necessary for the protection of property and persons situate therein, including, by way of example and not of limitation, the extinguishment of fires, and prevention of loss of life and property from fire, automobile accidents, medical emergencies, hazardous materials emergencies and other dangerous situations.
B. 
The companies may also provide nonemergency and public-service functions, including but not limited to stormwater removal from properties, and assisting in the abatement, removal and prevention of damage or injury to persons or property, whether through natural causes or man-made situations.
C. 
The companies may also conduct and participate in such training activities and drills, either within or outside the Borough, as may be deemed necessary by the officers of the companies, in order to maintain proficiency in the provision of services.
D. 
The companies may also respond to calls and provide services to municipalities outside this Borough, as may become necessary from time to time.
E. 
When designated, the companies may provide a past Fire Chief as the District Fire Marshal or Assistant Fire Marshal. This Marshal or Assistant Fire Marshal will be authorized by the Borough of Darby to act in that capacity, and in such capacity shall be afforded coverage under the Pennsylvania Workers' Compensation Act.[1]

In addition to actually participating in the activities of the fire companies as above authorized, or in going to and returning from any related activity, the members of the fire companies herein recognized are further authorized to:
A. 
Function.
(1) 
Fight fires and provide emergency services in Darby Borough and wherever asked to assist, for the humane purposes of protection and preservation of persons, places or things.
(2) 
Engage in any type of drill, training, ceremony, practice, test or parade when duly called for or authorized by the officers of the fire companies.
(3) 
Engage in any other activity reasonably related to the common and customary functions of such fire companies, when authorized by an appropriate officer or officers of the herein-recognized fire companies.
B. 
Coverage.
(1) 
The moment a fire alarm is sounded and/or a silent alarm is received.
(2) 
Fire drills and all parts thereof.
(3) 
Schooling for the improvement of firefighting and fire protection and prevention.
(4) 
Fire prevention in the form of school or public demonstrations, and public open houses.
(5) 
Care of trucks and/or apparatus.
(6) 
Fire meetings (while attending).
(7) 
Tag Day and/or other properly sanctioned fund-raising activities.
(8) 
Distributing and collecting raffle books.
(9) 
In December, Santa Claus/fire prevention for children.
C. 
Services rendered.
(1) 
Fire aid, rescues, salvage, fire police work, ambulance service in emergencies, radio communication, accident-scene assistance, animal rescue.
(2) 
Crowd control at both fire grounds and/or occasions of public or general assembly.
(3) 
Abatement and/or removal of hazards to public safety or health as may be defined or properly requested by Borough Council or its authorized employee(s) or agent(s).
(4) 
Participation in official holiday functions as directed by the Fire Chiefs or their designates.
(5) 
Abatement of conditions due to storms, floods and/or general peril, including but not limited to pumping cellars, helping with roofs, helping with fallen trees and aiding in other public peril, safety or health-related situations.
