This Part shall be known as the "East Nottingham Township Mobile/Manufactured Home Parks Licensing and Permitting Ordinance."

The purpose of this Part is to protect the health, safety, and welfare of the residents of East Nottingham Township including those who are occupants of mobile/manufactured home parks as herein defined.

This Part shall apply to mobile/manufactured homes which are located in mobile/manufactured home parks within East Nottingham Township.

ANCHORING
That method of securing the unit as defined in applicable statutes.
MOBILE/MANUFACTURED HOME
A transportable, single-family dwelling intended for permanent occupancy, contained in one unit, or in two or more units designed to be joined into one integral unit capable of again being separated for towing, which arrives at a site complete and ready for occupancy except for minor and incidental unpacking and assembly operations, and constructed so that it may be used without a permanent foundation.
MOBILE/MANUFACTURED HOME LOT
A parcel of land improved with the necessary utility connections and other appurtenances necessary for the erection thereon of a single mobile/manufactured home.
MOBILE/MANUFACTURED HOME PARK
For purposes of this Part, a parcel or contiguous parcels of land which has been so designated and improved that it contains four or more mobile/manufactured home lots for the placement thereon of mobile/manufactured homes and for which rental or lease payments are charged in any way.
MOBILE/MANUFACTURED HOME PARK PERMIT
A written permit used by the Zoning Officer and subject to annual renewal, permitting the mobile/manufactured home park to operate under this Part and other pertinent ordinances and regulations.
MOBILE/MANUFACTURED HOME PLACEMENT PERMIT
A permit for the placement of an individual mobile/manufactured home on a lot, also identified as a building permit.
PARK MANAGEMENT
The person who owns or has charge, care, or control of the mobile/manufactured home park.
REFUSE
All putrescible and nonputrescible solids except body waste including, garbage, rubbish, ashes, and dead animals.
SKIRT
A panel specifically designed for the purpose of screening the underside of a mobile/manufactured home by forming an extension of the vertical exterior walls of the mobile/manufactured home and covering the entire distance between the bottom of the exterior walls and the ground elevation below.

1. 
A building permit is required for all newly placed mobile/manufactured homes as well as the replacement of any existing mobile/manufactures homes located in a mobile/manufactured home park. No building permit shall be issued and no mobile/manufactured home shall be installed, constructed or otherwise placed in the Township for the purpose of use or occupancy, unless such mobile/manufactured home complies with the regulations contained in this Part and other ordinances of East Nottingham Township and all other applicable federal, state, or local statutes, ordinances, rules, and regulations.
2. 
A mobile/manufactured home park permit is required to be applied for and issued on an annual basis. This permit involves the inspections provided in this Part and in other ordinances of East Nottingham Township. The fee is as identified in a separately adopted fee resolution schedule. No mobile/manufactured home park may continue in operation absent having a valid current mobile/manufactured home park permit, which shall be prominently displayed in the park.

1. 
All existing mobile/manufactured home parks must be permitted in accordance with this Part.
2. 
All applicable provisions of the East Nottingham Township Subdivision and Land Development Ordinance [Chapter 22] shall be complied with for all new mobile/manufactured home parks, and where applicable, for all existing parks.
3. 
Each new or replacement unit in the mobile/manufactured home park shall comply with all the installation/construction requirements contained in this Part for mobile/manufactured homes, and all other ordinance, state and federal statutory requirements.

1. 
A mobile/manufactured home shall be manufactured or constructed in accordance with the safety and construction standards of the United States Department of Housing and Urban Development. Such standards are incorporated in and made a part of this Part.
2. 
Each mobile/manufactured home shall have a site graded to provide a level, stable and well-drained area.
3. 
Each mobile/manufactured home shall have wheels, axles, and hitch mechanisms secured or removed in accordance with any state and federal regulations.
4. 
Each mobile/manufactured home shall be placed on a permanent foundation in accordance with the manufacturer's installation requirements and in accordance with current statutory requirements.
5. 
Any stand or foundation shall not heave, shift, or settle unevenly under the weight of the home due to frost action, inadequate drainage, vibration, or other forces acting on the structure. Any stand area shall be prepared by removing the top soil and grading to slope of not more that 1/2 or 1% in any direction. The soil must be capable of supporting the weight of a home and must not be alluvial or highly organic.
6. 
All new mobile/manufactured home parks must comply with the Standards for Fire Safety Criteria for Manufactured Home Installation Sites, and Communities, current edition, as amended.
7. 
The skirting must be erected around the entire base of each home. Such enclosure shall provide sufficient ventilation to inhibit, decay and deterioration of the structure and further, the hitch of each home, if not removed, shall be enclosed in a manner to prevent injury.

1. 
Each mobile/manufactured home park owner and/or operator shall give notice to the East Nottingham Township Code Enforcement Officer and the East Nottingham Township Tax Collector in the event of any mobile/manufactured homes being removed and/or replaced and/or brought into any park.
2. 
Each mobile/manufactured home park shall be inspected on an annual basis and pay a licensing and inspection fee to East Nottingham Township based on a fee schedule established by separate resolution by the Township Board of Supervisors.

1. 
All mobile/manufactured homes within the park shall be connected to a public or community water supply system. Park management and/or owners must supply evidence that each individual home is connected to such a system.
2. 
All mobile/manufactured home parks shall establish an acceptable sanitary sewage disposal system.
3. 
Where feasible, all mobile/manufactured homes shall be connected to a community sewer system, if no community sewer system is provided, evidence of the sufficiency of the sewer systems of the park from the Department of Health shall be provided to the Township on an annual basis.
4. 
All household trash for each individual unit is provided for in trash receptacles and that individual trash collecting companies have contracted with individual lot owners for the pick-up and removal of trash and that no trash accumulation is permitted within the confines of the park except the weekly individual residential lot trash accumulation.
5. 
The park shall be inspected for a determination as to whether any rodent harborage, insect breading areas, or accidental fire or air pollution hazards are occurring by means of the refuse disposal system used on the park.
6. 
Compliance with §§ 14-110 and 14-111 must be shown.
7. 
Only one storage shed is permitted per lot.
8. 
New additions/structures to be attached to any mobile home shall comply with the Uniform Construction Code [Chapter 5, Part 1].

1. 
Interior private streets within the park shall be situated so that each mobile/manufactured lot shall abut and have access to such street. All cartway construction shall conform to the right-of-way widths and cartway widths specified in the East Nottingham Township Subdivision Ordinance [Chapter 22]. If the private streets with the mobile/manufactured home park pre-existed the standards established in the ordinance, the park owner upon inspection must show that the streets are free and clear of debris and sufficient parking area is available for the residents so that adequate clearance is available for emergency vehicles.
2. 
Each mobile/manufactured home park owner or management entity must show sufficient off-street parking or location adjacent to the private streets to allow two spaces per dwelling.

1. 
The park management shall operate the park in compliance with all East Nottingham Township ordinances and shall provide adequate supervision to maintain the park, its facilities and equipment in good repair in a clean and sanitary condition.
2. 
The park management shall supervise the placement of each home on its lot which includes securing its stability and installing all utility connection.
3. 
The park management shall give any authorized officer free access to all lot, service buildings and other community service facilities for the purpose of inspection.
4. 
The park management shall maintain a register containing the names of all occupants. This register shall contain the name and prior address of owner and occupants including forwarding address for past occupants, dates of entrance and departure, and the lot number on which such home is located.
5. 
The numbering of each lot shall be clearly legible and visible and in compliance with the established street names and house numbers established by the County of Chester through its 911 Emergency Management Program.

Any person, firm or corporation who shall violate any provision of this Part, or who shall fail or refuse to comply with any lawful notice, order or direction of a Township official, agent or employee, upon conviction thereof in an action brought before a magisterial district judge in the manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure, shall be sentenced to pay a fine of not less than $300 nor more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 90 days. Each day that a violation of this Part continues or each section of this Part which shall be found to have been violated shall constitute a separate offense.

The following words and terms, as used in this Part, shall have the meaning respectively ascribed to them in this section, unless the context clearly indicates a different meaning.
PERSON
Any natural person partnership, firm, association, or corporation.
TOWNSHIP
The Township of East Nottingham, Chester County, Pennsylvania.
TRAILER
Any structure which is mounted, or adaptable to be mounted on wheels, and which includes accommodations for sleeping or living purposes for one or more persons, excepting a device used exclusively upon stationary tracks or rails.
2. 
In this Part, the singular shall include the plural and the masculine shall include the feminine and the neuter.

No person shall move, transport, and/or relocate any trailer in, within or into the Township, or allow or permit any trailer to be moved, transported, and/or relocated in, within, or into the Township without first having obtained a permit from the Township Secretary to do so.

1. 
Any person desiring to move, transport, and/or relocate any trailer in, within, or into the Township shall apply to the Township Secretary for a permit, and shall give the following information:
A. 
The name and address of the owner of said trailer.
B. 
The final destination of the said moving, transportation, and/or relocation of the trailer.
C. 
The name and address of the owner of the land where said trailer will be finally moved, transported, and/or relocated.
D. 
The name of the person or persons who will reside in said trailer once it has reached its destination.
E. 
Satisfactory compliance with any and all ordinances or statutes effecting said moving, transportation, and/or relocation.
2. 
Such application shall be accompanied by a fee in an amount as established from time to time by resolution of the Board of Supervisors to cover the cost of the services and the cost of the permit.
