There is hereby imposed an annual rental or charge upon the owners of properties served or to be served for the use of the sewers and sewer system of the Township of Thornbury and for the use of extensions thereof which are in the course of construction or to be constructed and for the use of the sewage treatment works.

1. 
The annual sewer rental or charge shall be such sum as shall be sufficient to meet the following classes of expenses:
A. 
The amount expended annually by the Township in the operation, maintenance, repair, alteration, inspection, depreciation or other expense in relation to such sewer, sewer system, pumping stations or sewage treatment works.
B. 
An amount sufficient to establish a margin of safety in the maintenance and capital improvement fund as established annually by the Township.

The Board of Supervisors of Thornbury Township declares that the fair manner in which to equitably apportion the total service rental or charge is for the Township, or its operator, to divide the total estimated annual budget for the ensuing year by the number of properties connected and using the Township sewer plant or sewage system and said amount shall be the annual sewer rental.

In December of each year, estimated sewer rental bills for the ensuing year shall be computed by the Township or its contracted agent. It shall be the duty of the Township Treasurer to certify a copy of said estimated sewer bills to the Board of Supervisors, which shall, by resolution, fix the sewer rental for the ensuing year which shall be collected in quarterly installments. In the event a deficit occurs for the present year, then the Board of Supervisors shall, by resolution, adopt a final sewer rental in a sufficient amount to retire any deficit.
A. 
Collection of Sewer Rent.
(1) 
In the event any sewer rent or charge shall become delinquent and not paid for a period in excess of 30 days from the due date, the same shall be collected by the Township in the manner provided by law.
(2) 
In addition to the provisions and remedies as provided herein, the Township of Thornbury shall be authorized to invoke the provisions of the Act of April 14, 1949, P.L. 482, as amended, 53 P.S. § 2261, providing for any water company or authority providing services to the customer and user and duly authorized to shut-off the water supply to the customer or user to enforce collection of said unpaid rental, rate, or charges for sewer usage.

The Township reserves the right to amend or modify this article or any parts thereof at any time or from time to time.

Any person, firm or corporation who shall violate any provision of this article, upon conviction thereof in an action brought before a District Justice in the manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure, shall be sentenced to pay a fine of not more than $1,000 plus costs and, in default of payment of said fine and cost, to a term of imprisonment not to exceed 90 days. Each day that a violation of this article continues or each section of this article which shall be found to have been violated shall constitute a separate offense.
