All residents are encouraged to separate recyclable materials
from solid wastes and prepare recyclable materials by rinsing all
designated bottles, cans, jars, and jugs, having removed and discarded
all caps and lids, and placing the designated materials in the designated
recycling bin or container and placing this container at curbside
on the same day as collection of solid waste. Newspapers are to be
bundled and tied with twine or placed in paper bags, and placed on
top of the recycling container.
Residential recyclable materials include newsprint, aluminum
cans, bimetallic (steel or tin) cans, clear, brown and green glass
bottles and jars, No. 1 (PET or PETE) and No. 2 (HDPE) plastic bottles
and jugs.
Commercial/industrial recyclable materials include all those
previously listed along with the addition of high-grade office paper
and corrugated paper.
Recyclable materials placed at curbside become public property
and may not be scavenged.
All haulers collecting solid wastes within the municipality
are also required to collect recyclable materials on the same day
as that upon which solid wastes are collected. Recyclables are to
be kept separated from solid wastes and kept clean.
Haulers are required to distribute county furnished recycling
containers to their customers.
Haulers are required to transport and dispose of recyclable
materials at a recycling processing center licensed by the County
of Blair. Solid wastes must be transported and disposed of at a permitted
transfer station, or landfill or other disposal facility approved
by the Blair County Waste Management Plan. All licensed haulers shall
deliver all recyclables to a recycling processing centers licensed
(or otherwise approved) by the County of Blair in accordance with
the following procedures:
A. Corrugated paper. Must be clean, dry, domestic nonwaxed corrugated
paper (cardboard). Asian-made cardboard or pressboard shall not be
delivered to any center for processing.
B. Glass. All glass must be separated by color (clear, green and brown).
Only bottles and jars will be accepted. Caps and lids must be removed.
No ceramics, china, drinking glasses, plate glass, light bulbs or
Pyrex ware shall be included. Mixed colored glass shall not be delivered
to any center for processing.
C. High-grade office paper. White ledger paper and computer printout
paper may be mixed together. No colored paper, address labels, Post-It
notes, paper clips, envelopes, fax paper, NCR carbonless duplicate
paper or other mixed papers shall be included. All must be clean and
dry and free of excessive contamination.
D. Metal cans. Steel, aluminum and bimetallic food and beverage cans
shall also be accepted. No aerosol cans shall be accepted. All material
should be free of food residue and liquid paint.
E. Plastic. Only No. 1 (PET or PETE) and No. 2 (HDPE) plastic bottles
and jugs shall be delivered. Containers must be free of residue with
caps and lids removed. No wide mouth tub containers (margarine, yogurt,
etc.), nor any automotive petroleum-based fluid container shall be
delivered to any center for processing.
F. Newsprint. Must be free of wet or excessively soiled paper. Newsprint
may be contained in paper bags or bound with twine.
G. Contamination of recyclables. Plastic bags of any type or size shall
be considered contaminants. All recyclables must be removed from plastic
bags. Licensed recycling centers shall be permitted to reject any
and all loads of recyclables that are excessively contaminated. Contamination
that is discovered in a load of recyclables after the hauler has left
the processing center may be the responsibility of the hauler.
H. Restrictions. All recyclables shall be delivered to one licensed
center. Licensed haulers are not permitted to market some recyclables
for profit while dumping lower valued recyclables at licensed centers.
Notwithstanding anything herein contained to the contrary, marketing
of newspapers through farmers for animal bedding shall be a permitted
exception to delivery of all recyclables to one center.
Recycling processing centers utilized by waste haulers operating
in the Township of Blair must be licensed by the County of Blair.
All haulers must be licensed by the County of Blair through
the Blair County Department of Solid Waste and Recycling and are subject
to regulation by that Department. Haulers must satisfy the following
requirements:
A. All vehicles being driven by the hauler or the employee thereof must
have a current Pennsylvania inspection.
B. All drivers must have a valid driver's license.
C. All employees of the hauler must be covered by workers' compensation.
D. All vehicles being driven by the hauler or the employee thereof must
have appropriate liability insurance.
E. All trucks being used by the hauler must be properly equipped with
appropriate tarp so that the waste collected and being transported
with the Township remains within said trucks.
F. All haulers operating in the Township of Blair must have a current
license in good standing issued by the County of Blair for the specific
type of waste said hauler hauls (i.e., municipal, construction and
demolition, leaf waste and grass clippings, septage and/or wastewater
treatment sludge).
G. All pickup and hauling shall be done Monday through Saturday.
Haulers are not permitted to collect, remove or transport waste on
Sundays, Thanksgiving Day, Christmas Day or New Year's Day.
If, for any reason, a hauler operating in the Township of Blair
shall lose his/her/its license with the County of Blair, said hauler
shall be required to give immediate notice thereof to the Township
of Blair.
Any hauler who fails to secure a license from the County of
Blair and who nevertheless engages in hauling of waste, or is involved
in the collection, transportation or disposal of said waste without
a license, or violates this chapter in any other manner shall, upon
being found liable therefor in a civil enforcement proceeding commenced
by the Township before a Magisterial District Judge, pay a fine of
not more than $600, plus all court costs, including reasonable attorneys’
fees, incurred by the Township in the enforcement of this chapter.
No judgment shall be imposed until the date of the determination of
the violation by the Magisterial District Judge. If the defendant
neither pays nor timely appeals the judgment, the Township may enforce
the judgment pursuant to the applicable Rules of Civil Procedure.
Each day a violation exists shall constitute a separate offense. Further,
the appropriate officers or agents of the Township are hereby authorized
to seek equitable relief, including injunction, to enforce compliance
herewith.
The Township of Blair also reserves the right to secure injunctive
relief in addition to the filing of summary proceedings and neither
shall be exclusive. If a hauler repeatedly violates this chapter,
the Township of Blair can seek injunctive relief and the hauler shall
be responsible for all costs in connection with said suit along with
reasonable attorneys' fees incurred by the Township.
Recyclables shall be collected from single-, two- and three-family
residences at least once every other week and from multifamily dwellings
of four or more units at least once a week. Recyclables from commercial
establishments shall be collected at least once a week.
Owners of multifamily residential properties of four or more
units are encouraged to provide suitable containers in which occupants
can place recyclables for collection. The containers are to be placed
at a location suitable to the owner and to the servicing hauler.
Commercial, municipal, educational and institutional establishments,
as well as the sponsors of community events, are encouraged to separate,
prepare, store and dispose of recyclable materials as do residents.
Residential, other than multifamily, collection of recyclables
shall be in uniform collection containers as specified and furnished
by the county. Residents issued such containers are responsible for
their care and, if necessary, replacement.
