"Swimming pool" as used in this chapter means any artificial body of water over 18 inches deep used or intended to be used for wading or swimming, constructed, installed or maintained in or above the ground on private property within the city, but does not include any such body of water that is located within a residential building.

Every person who constructs a swimming pool shall, before commencing construction, furnish plans and specifications to the building inspector for approval and pay building permit fees as required by this title.

(A) 
Every person in possession of land within the city upon which a swimming pool is being constructed shall maintain a temporary fence or solid structure completely enclosing such construction.
(1) 
The temporary fence or structure shall be placed immediately upon commencement of construction.
(2) 
The temporary fence or structure shall be subject to approval by the building inspector.
(3) 
The temporary fence or structure shall remain in place until replaced by a permanent fence or structure as set forth in subsection (B) of this section.
(B) 
Every person in possession of land within the city upon which a swimming pool is located shall maintain a permanent fence or solid structure completely enclosing such swimming pool.
(1) 
The permanent fence or structure shall be placed within 10 days after the completion of construction.
(2) 
The permanent fence or structure shall be not less than four feet in height.
(3) 
Except for gates and doors, no opening in such fence or structure shall be larger than six inches square.
(4) 
Each gate and door opening through the fence or structure shall be equipped with a self-closing and self-latching device that is capable of keeping the door or gate securely closed at all times when not in actual use.
(C) 
All gates or doors opening through the temporary or permanent fence or structure shall be kept securely closed at all times when not in actual use.

Fees for plan examination and for issuance of any permit required by this chapter shall be set by resolution of the council. All city departments and agencies shall be exempt from the payment of fees required by this chapter. Notwithstanding the forgoing fees required by this chapter shall be paid for plan examination and for issuance of any permit for work performed by the housing authority, water utility, storm water utility or wastewater treatment plant.

A person who violates any provision of this chapter shall upon conviction be subject to a Class 3 forfeiture. A separate offense exists each calendar day during which a violation occurs or continues.
