As used in this article, unless the context clearly indicates a different meaning, words shall have the meanings set forth below:
BUILDING
Any structure located within the Borough of Bellevue, whether occupied or unoccupied.
OWNER
Any person who alone, or jointly or severally with others, shall have legal title to any building, structure or property, with or without accompanying actual possession thereof.
PERSON
Includes a corporation, firm, partnership, association, organization and any other group acting as a unit, as well as individuals. A person shall also include an executor, administrator, trustee, receiver or other representative appointed according to law. Whenever the word "person" is used in any section prescribing a penalty or fine, as to partnerships or associations, the word shall include the partners or members thereof; as to corporations, it shall include the officers, agents or members thereof who are responsible for any violation of such section.
PROPERTY
Any lot located within the Borough of Bellevue, whether the lot is vacant or has a structure erected thereon.
PUBLIC DISTURBANCES
Any party, gathering, event or disturbance involving disorderly conduct, public disturbances or nuisances, disturbing the peace, excessive or unlawful consumption of alcohol or use of illicit drugs, as described in any other ordinance of the Borough of Bellevue and/or any state statute.
A. 
It is hereby deemed that in the event two police calls are dispatched to a particular property and/or building within a consecutive thirty-day period or less, each and every call in excess of two is presumed to be excessive.
B. 
This article is intended to address excessive police calls arising from disorderly conduct, public disturbances or nuisances, disturbing the peace, excessive or unlawful consumption of alcohol or use of illicit drugs, and the like, as described in any other ordinance of the Borough of Bellevue and/or any state statute, recurring in the same location, including, but not limited to, excessively loud music or parties, public alcohol consumption, drug use, late night noise, chronic dog barking, etc. This article is not intended and shall not be interpreted to cover police calls related to domestic violence, child abuse or other significant forms of criminal activity in which the residents/occupants of the property are alleged to be victims of other criminal conduct engaged in by persons other the residents/occupants or other persons present on the property or their invitees.
There is hereby imposed a fee of $100 for each and every excessive police call. Such fee is to be paid by the owner of the property and/or building.
A. 
It shall be the duty of the Borough Police Department, on behalf of the Borough of Bellevue, to enforce the provisions of this article.
B. 
Upon the occurrence of the second police call occurring within a consecutive thirty-day period or less, the Borough Police Department shall notify the owner that the next call will result in imposition of the above fee.
C. 
Where a resident violates the provisions of this article, notice of such violation and imposition of the fee shall be served by either hand delivery or certified mail, return receipt requested, to either the owner's residence or the owner's address appearing on the property's real estate tax blotter.
D. 
The Borough Police Department shall invoice, collect and receive such fees imposed by this article, and it shall maintain records showing the amounts and dates such amounts were received. Upon collection of such fees, the Police Department shall forward all fees collected and a complete accounting thereof to the Borough Secretary.
Any person who fails to pay the fee imposed by this article within 10 days of the date of notice shall be subject to prosecution in a summary proceeding before a Magisterial District Judge and shall, upon conviction thereof, be guilty of a summary offense which is punishable by a fine of not less than $300 and no more than $500 plus costs of prosecution and the amount of the fees. In default of payment of such fees, fines and costs, the owner shall be subject to imprisonment not exceeding 30 days.

Upon a resident's request, and upon payment of such administrative fee as established by or pursuant § 198-7 hereof, the Borough Police Department shall prepare and provide to the requesting resident a certified fingerprint card for the resident's use in employment and other civilian background checks, for Act 33 child abuse clearances and the like, or for other such noncriminal purposes.
There is hereby established, and the Borough and its Police Department is hereby authorized to charge and collect, an administrative fee to defray the administrative costs of providing the foregoing service in the following amount, or in such other amount as may be adopted from time to time hereafter by resolution of Town Council: $15 (which fee shall cover the cost of providing not more than two certified fingerprint cards per request).
