GENERAL REFERENCES

The intent of this chapter is to establish rules for enclosed dumpster areas for commercial properties and residential properties consisting of four or more dwelling units, in order to prevent accumulations of garbage and rubbish from spreading throughout the Village and endangering the health and welfare of citizens, and enhance the aesthetic appearance of the community.
A. 
This chapter shall apply to:
(1) 
All commercial and industrial buildings and properties, all multi-family residential buildings consisting of four or more dwelling units; and
(2) 
All townhouse and condominium developments consisting of four or more dwelling units.
B. 
Dumpsters and similar large receptacles shall be fully shielded from view from any public street by means of appropriate landscaping, hedges, fences, screening or an enclosure. In the event that site conditions of a particular property make compliance with these requirements impracticable, the owner thereof may apply for a waiver from the Village Board. In granting such a waiver, the Board shall impose such reasonable conditions as to effectuate the intent of this section to minimize the visibility of such dumpster or similar large receptacle. Such dumpster or similar large receptacles shall not be kept in a front yard or exterior side yard unless otherwise permitted by the Village where no feasible alternative exists.
C. 
Property owners must keep full enclosures and partial enclosures in good repair and in a safe and structurally sound condition. Property owners must maintain the effectiveness of vegetation screens by properly caring for and replacing, as necessary, the plantings that serve as screening devices.
D. 
All dumpsters subject to this chapter shall be placed on a concrete or other impervious pad.
E. 
The size and placement of dumpsters and dumpster enclosures proposed to be installed or placed on or after the effective date of this chapter are subject to the approval of the Village of Harriman Planning Board and shall be included as part of the Village site plan review procedures.
Violations of this chapter shall be punishable as provided in § 70-6 of the Village Code.
