Whenever hereafter the Council of the Borough of Ben Avon, by ordinance or resolution, shall require the grading, paving and curbing or the recurbing, repaving and regrading of any of them or the repairing of any sidewalk within the Borough of Ben Avon, such sidewalk and curb, or either of them, shall be constructed, reconstructed or repaired at the established grade.

1. 
The curb shall be set along the extremities of the street:
A. 
The width of sidewalks will be determined by the width of the street, curb to curb, as follows:
(1) 
On all streets less than 30 feet wide: three feet.
(2) 
On all streets 30 feet wide and less than 40 feet wide: five feet.
(3) 
On all streets over 40 feet wide: seven feet.
Provided: Where a considerable portion of the sidewalk on any block of a street shall have been paved at a width different from that prescribed hereinabove, the Borough Council may direct that all sidewalk along such block hereafter constructed, reconstructed or repaired shall conform to such prevailing width rather than to that hereinabove prescribed.

1. 
When the Borough Council directs the grading, paving and curbing, or any of them, of the sidewalk along any street within the Borough, or the repaving, regrading or recurbing thereof, or any of them, such work shall be constructed of concrete in the following manner:
A. 
For the purpose of pavement, the sidewalk shall be excavated nine inches below the established grade.
B. 
At the bottom of the excavation there shall be placed a bed of broken stone or gravel well rolled or tamped and five inches thick.
C. 
Upon this bed shall be placed a bed of concrete well rolled or tamped four inches thick.
D. 
The sidewalk shill slope toward the curb 1/4 inch per foot.
E. 
Slab Size. The aide walk shall be built in slabs not more than six feet in length nor contain more than 36 square feet in surface area.
F. 
Joints. Expansion joints shall be placed at intervals not exceeding 36 feet and at each end of every section of walk, expansion material 1/2 inch thick and of a width equal to the depth of the slab shall be used. The joint material shall be set in place in a vertical position and true to line and properly blocked in place. All castings and utility boxes in the sidewalk area shall be set to grade and properly boxed out in the slab layout.

Concrete shall be composed of cement, fine aggregate, coarse aggregate and water proportioned as below and mixed to produce a plastic workable mixture and suitable for specific conditions of placement.

The material shall be mixed with sufficient water to produce a concrete which will hold its shape when struck off with a striking board. The consistency shall not be such as to cause a separation of the coarse aggregate from the mortar in handling. The mix shall be sufficiently dry to eliminate the pooling of water on the surface when struck off with a striking board.

After the concrete shall have been brought to the established grade by means of a striking board, it shall be worked with a steel trowel or wood float to get the desired surface hereinafter specified. In no case shall dry cement or a mixture of dry cement and sand be sprinkled on the surface to absorb moisture or to hasten hardening. The surface shall be flanged as hereinbefore on a form and shall be given a true, even finish with a wooden float, cane being taken that none of the coarse aggregate is exposed. After rolling and finishing, a brush finish shall be used to give a rough surface to the sidewalk.

The standard cross section for straight curb shall be at least eight inches at the top, eight inches at the bottom, and 30 inches in depth. The top corner or the face of the curb shall be reminded to a radius of at least 3/4 inch and the top corner on the back of the curb shall also be neatly rounded with special tools. The mix and specifications shall be those used for sidewalks (Class A-m concrete).
A. 
Tie bars shall be 3/4 inch by two feet long placed at all joints and three inches from top of curb. At expansion joints, one-half shall be wrapped with paper to prevent bond. Maximum curb section length shall be 10 feet — zero inches. Three-quarter inch bituminous expansion material shall be placed at 60 feet intervals and at the end of all radius returns and at inlets.
B. 
Transition from typical section at driveways shall be made in a distance of 12 inches. Width of the curb cut shall be set in the field.

Upon any street where a sidewalk five feet or more in width shall be prescribed, the Council may authorize and direct the construction and maintenance of all sidewalks upon any specific block or square thereof as follows: the paved portion thereof to be five feet wide and to be laid one foot from the property line, with the balance of the sidewalk area planted in grass and available for the planting of trees. Provided: the arrangement specified by this section shall not be permitted or required in any block or square of any street unless the owners of a majority of the foot frontage of property abutting upon such street shall request permission from the Council therefor.

When the Council by resolution or ordinance shall direct the grading, paving and curbing, or the regrading, repaving and recurbing, or the repairing, or any of them, of any sidewalk in the Borough, a notice so to do shall be served upon the owner of the premises abutting upon such sidewalk to do such work, if such owner is a resident of the Borough. If the owner is not a resident, than the notice may be served upon the agent or tenant of the owner, or upon the occupant of such premises. If the owner has no agent or tenant or if there is no occupier of such premises, then service shall be by notice posted upon the premises. Such notice shall require that the work of grading, paving and curbing, or of regrading, repaving and recurbing, or any of them, be completed within 60 days after such notice, and that the work of repairing be, completed within 30 days after such notice. If any such work shall not have been completed within the time limit specified in such notice, the Borough may cause such work to be done and the cost thereof, together with a penalty of 10% additional, shall be collected from the owner of such property, and the Borough may file a municipal claim therefor or may collect the same by action in assumpsit. Provided: nothing herein shall preclude the Borough, under appropriate circumstances, from proceeding under the sections of the Borough Code, 53 P.S. § 45101 et seq., as amended from time to time, applicable to sidewalks creating nuisances wherein the safety of pedestrians is imminently jeopardized, or to the requiring and making of emergency repairs of sidewalks at limited expense and within a limited time.
