From and after the enactment of this Part it shall be unlawful for any person, firm, or corporation to construct, erect, or maintain, on any part of the sidewalks of the streets of the Borough of Ben Avon, between the curb and property line, on either side of said streets, any post, pole, pump, gasoline pump, gasoline filling device, oil pump, oil filling device, or other obstruction.

Within 10 days after the enactment of this Part every person, firm or corporation owning, maintaining or using any post, pole, pump, gasoline pump, gasoline filling device, oil pump, oil filling device, or other obstruction on any part of the sidewalks of the streets of the Borough of Ben Avon, on either side of said streets, between the curb and the property line, shall remove the same from said sidewalks, and the ownership, maintenance, or use of the same after the expiration of said 10 days is hereby declared to be unlawful.

Any person, firm or corporation, violating any of the provisions of this Part, upon conviction thereof, shall be sentenced to a fine of not less than $25 nor more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 30 days. Each day that a violation of this Part continues or each section of this Part which shall be found to have been violated shall constitute a separate offense.

Sections 21-402 and 21-403 of this Part shall not be construed to include necessary telegraph, telephone, street railway, electric light or other poles of public service corporations operating under franchise grants from the Borough of Ben Avon.

The Chief of Police of the police force providing police protection services to the Borough is hereby authorized, empowered and directed, with the aid of such suitable posse as may be necessary, to tear down and remove from the sidewalks of the streets of the Borough, any obstruction erected, maintained, owned, or used in violation of any of the provisions of either §§ 21-402 or 21-403 of this Part.
