The Township's policies and procedures related to the oversight, inspection, management, and administration of stormwater control systems and facilities within the Township of Pine shall include, but not be limited to, the following:
A. 
Except as otherwise may be provided herein, the Township of Pine shall proceed in accordance with the procedures set forth in the Second Class Township Code (Article XXVII; 53 P.S. § 67601 et seq.).
B. 
The Board of Supervisors shall establish any stormwater management district by enactment of an ordinance therefor.
C. 
Each property owner within a stormwater management district may be required to dedicate, free of cost, public right-of-way through such property to facilitate the construction, installation, alteration, inspection, or maintenance of the stormwater control systems and facilities.
D. 
The Board of Supervisors may authorize and elect to directly bid and award any contract to construct, install, alter, inspect, repair, or maintain such stormwater control systems and facilities, pursuant to the established procedures of the Township of Pine.
E. 
The Township of Pine may make the initial payment of all necessary costs and expenses for the construction, installation, alteration, inspection, repair, or maintenance of stormwater control systems and facilities, including associated engineering and legal fees.
F. 
All property owners within a stormwater management district shall be assessed by the Township of Pine for all such costs and expenses in connection with the stormwater-related activities specified in this article, with such assessments to be instituted and enforced in a manner authorized and permitted by Article XXVII (Storm Water Management Plans and Facilities) of the Second Class Township Code, as most recently amended July 1, 2016, by P.L. 439, No. 62. Any funds collected through such assessments of fees upon property owners shall be used by the Township of Pine solely for the purposes authorized by the provisions of the above-referenced Article XXVII of the Second Class Township Code.
G. 
Any owner of property so assessed by the Township of Pine shall have such assessment filed with the Township Treasurer and shall be responsible to pay same in annual or more frequent installments (as may be specified in the ordinance which establishes such stormwater management district or otherwise establishes the assessment related thereto).
H. 
A municipal lien shall be filed by the Township of Pine against all properties within the stormwater management district for which the assessments are not immediately paid in full in the amount of said assessment.
I. 
Attorneys' fees incurred on all accounts referred to the Township's Solicitor for enforcement and collection shall, if not collected in due course with the debt as by voluntary agreement, shall be included in all claims (including liens) filed on behalf of the Township of Pine in the course of enforcement, including (if accrued before liening) in any claim originally filed with the Prothonotary and in accordance with Ordinance No. 281 of the Township of Pine.[1]
