Any person who shall violate any of the provisions of Part 2 of this chapter shall, upon conviction thereof, be sentenced to pay a fine of $50 together with the costs of prosecution. Any person who shall violate any other provision of this chapter shall, upon conviction thereof, be sentenced to pay the fine then levied for such a violation under the applicable section of the Pennsylvania Motor Vehicle Code, 75 Pa.C.S.A. § 101 et seq.

Any fine provided herein for a violation in Part 2 of this chapter shall be reduced to $10 if payment is made to the Borough of Ben Avon, at the Borough Hall within 240 hours from the notice of violation. The notice of violation shall be substantially in the form attached, as may be revised by Borough Council from time to time.

For each violation of the provisions of § 15-113, pertaining to the prohibition of engine brake usage, unless another penalty is specifically provided for in the Pennsylvania Motor Vehicle Code, any person who commits, takes part in or assists in any such violation, including, but not limited to, the operator and owner of the vehicle involved in the violation, shall be liable, upon conviction thereof in a summary proceeding, to pay a fine of up to $1,000 for each offense, together with the costs of prosecution. Each application of an engine brake in violation of § 15-113 shall be a separate offense. In default of payment of such fine, such person shall be liable to imprisonment for a period not exceeding 30 days.
