The Board of Supervisors of Hopewell Township hereby adopts the Hopewell Area Recreation Complex Rules and Regulations attached as Schedule 16-1-A and incorporated by reference, for the use of the facility by the public.

Any organization or group that conducts or sponsors any activity or event at the facility shall be responsible for the conduct of its participants and guests, and shall be subject to the penalties for violations as set forth in § 16-107.

The rules and regulations in Schedule 16-1-A shall be posted for view by the public in the Township building, at the facility and on the Township's website.

The rules and regulations may be amended from time to time by resolution of the Township's Board of Supervisors, in which case the amended rules and regulations, once adopted, shall be posted in the same manner and places as set forth in § 16-103 of this chapter.

A copy of the then current rules and regulations shall be provided as part of the application for use to any person, organization, group, corporation or other entity who or which schedules any activity or event at the facility.

The Board of Supervisors requires that all users of the facility shall conduct themselves and their activities in a manner that will not obstruct or interfere with the use or enjoyment of the facility by others. Respect for, courtesy to, and cooperation with other users is expected, and failure of any user, whether an individual, organization, group, corporation or other entity to conduct themselves accordingly. The Township reserves the right to deny the use of the facility to any persons, organization, group, corporation or other entity, who or which, in the sole discretion of the Board of Supervisors, violates this section or any of the rules and regulations.

Any person, organization, group, corporation or other entity who or which shall violate any of the rules and regulations, or any future amendments to them, upon conviction thereof in an action brought before a magisterial district judge in the manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure, shall be sentenced to pay a fine of not less than $250 nor more than $1,000 plus costs and reasonable attorney fees incurred by the Township in the enforcement proceeding and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 90 days. Each day that a violation of this Part continues or each section of this Part which shall be found to have been violated shall constitute a separate offense.

The Pennsylvania State Police, or such other police department that from time to time is designated as the police services provider for the Township, the Township's Codes Enforcement Officer, and the Township's Animal Control Officer shall have the jurisdiction and authority to issue summary criminal citations for violation of this Part or the then current rules and regulations adopted or amended pursuant to this Part or the procedures set out in § 16-104. The authority of the Codes Enforcement Officer and the Animal Control Officer to issue summary criminal citations shall be limited to non-traffic summary citations, as provided by law. Summary criminal citations may be issued based on personal observation of the person issuing the citation, or on information received.
