In every instance where the Township Supervisors, Engineer, Roadmaster, or other appropriate parties determine that trees having a trunk diameter in excess of six inches must be removed for the improvement, use, or maintenance of a public road or street in the Township or that such trees constitute a hazardous or dangerous condition to the use of the highway, then a notice shall be sent to each property owner abutting that portion of the right of way from which such trees are to be removed. The notice shall be in substantially the form attached hereto, marked Exhibit 25-1-A, and incorporated by reference herein.

All such notices to be sent out pursuant to § 25-101 shall be sent to the property owner either by certified mail, return receipt requested, or by personal delivery by an employee of the Township. In either event, a copy of the notice shall also be mailed by first class mail, postage prepaid. In the event that an employee of the Township hand delivers such notice, then the employee shall fill out a certification of delivery in substantially the form attached as Exhibit 25-1-B, and incorporated by reference. Hand delivery of such notice shall only be permitted if the Township employee hands the notice to an adult individual in or on the property who acknowledges that he or she is an adult resident of the property, or who the Township employee knows to be an adult resident of the property by personal knowledge.

All other procedures for notification shall be as set forth in a document titled "Procedures for Notification of Tree Removal in a Street or Road Right-of-Way," which procedures are attached hereto, marked Exhibit 25-1-C, and incorporated by reference herein.

By approving specific road improvement projects, the Board of Supervisors of the Township shall be deemed to approve and authorize the removal of any and all trees and shrubs within the street or road right-of-way as are necessary to complete each such project, so long as the removal of such trees is approved by the Roadmaster in consultation with the Township Engineer. No further approval or authorization shall be required in those instances. However, all other provisions of this Part shall be met in such cases.
