Pursuant to Section 11 of the Uniform Fire Safety Act (P.L. 1983, c. 383) the New Jersey Uniform Fire Code shall be locally enforced in the Municipality of the Borough of Monmouth Beach.

The local enforcing agency shall be the Municipal Fire Bureau.

The local enforcing agency shall enforce the Uniform Fire Safety Act and the codes and regulations adopted under it in all buildings, structures, and premises within the established boundaries of the Borough of Monmouth Beach, other than owner-occupied one- and two-family dwellings, and shall faithfully comply with the requirements of the Uniform Fire Safety Act and Uniform Fire Code.

The local enforcing agency established by Section 16-2 of the section shall carry out the periodic inspections of life hazard uses required by the Uniform Fire Code on behalf of the Commissioner of Community Affairs.

The local enforcing agency established by Section 16-2 of this section shall be a part of the Department of Public Affairs and Public Property and shall be under the direct supervision and control of the Fire Marshal, who shall report to the Commissioners of the Borough of Monmouth Beach.

a. 
Appointment of fire marshal. The local enforcement agency shall be under the direct supervision of the Fire Marshal.
b. 
Term of service. The Fire Marshal shall serve for a term of four years.

Pursuant to Section 15 and 17 of the Uniform Fire Safety Act, any person aggrieved by any order of the local enforcing agency shall have the right to appeal to the Construction Board of Appeals of Monmouth County.

In addition to the inspection and fees required pursuant to the Act and the regulations of the Department of Community Affairs by the Uniform Fire Code, the following non-life hazard uses shall register with the Bureau of Fire Prevention. These uses shall be inspected once per year and pay an annual fee.

Common areas.
1. 
Common areas. Shopping centers, strip malls, office buildings, office complexes, residential complexes and other commercial complexes that share common area, including but not limited to corridors, atriums, stairwells, fire protection systems, fire lanes and parking lots. A fee of $50 per year.

Uses not classified above that are subject to the Uniform Fire Code will be classified as business uses.
k. 
Uses required to register with the State as life hazard uses shall not be required to register under this section, with the exception of common areas and secondary uses.
l. 
In the discretion of the Borough Fire Marshal, vacant buildings will be charged and inspected according to the previous use of the building.

Pursuant to the provisions of N.J.S.A. 40A:14-53 and N.J.S.A. 40:48-24.6, the Borough Fire Official is hereby authorized to establish within parking places or areas to which the public is invited fire zones in which all vehicular parking is prohibited and to require the owner of said parking places or areas to appropriately delineate and mark said area as a fire zone in which parking is prohibited.

Parking of vehicles in designated and marked fire zones throughout the Borough is hereby prohibited.

Any owner of a parking place or area who refuses to comply with the directive of the Borough Fire Official shall be subject to a fine and costs of Court.

Any person who violates the no parking provision of this section shall be subject to a fine not to exceed $50 and costs of Court.
