The purpose of this article is to establish all-terrain vehicle
(ATV) and utility terrain vehicle (UTV) routes in the City of Lancaster
and regulate the operation of all-terrain and utility terrain vehicles
in the City.
Operation of ATVs and UTVs shall be subject to all provisions
of § 23.33, Wis. Stats., as the same may be amended from
time to time.
The designated all-terrain vehicle and utility terrain vehicle
routes within the City of Lancaster shall be on portions of the roads
and streets as set forth below:
A.
Commercial Road from U.S. Highway 61 to Industrial Park Road.
B.
Industrial Park Road from Commercial Road to U.S. Highway 61.
C.
McKinley Street from County Highway A to State Highway 35 and 81.
D.
Western Avenue from State Highway 35 and 81 to the South Lancaster
township border on Old Potosi Road.
E.
County Highway A from the Grant County Fairgrounds main entrance
to State Highway 129.
F.
Roosevelt Street from County Highway A to Lincoln Avenue.
G.
Lincoln Avenue from Roosevelt Street to State Highway 129.
H.
Enterprise Street from U.S. Highway 61 to Ihm Street.
I.
Ihm Street from Enterprise Street to County Highway K.
J.
County Highway K from Ihm Street to Old County Highway K.
K.
Old County Highway K from County Highway K to U.S. Highway 61.
L.
City Limits Road from the New Horizons South entrance to U.S. Highway
61.
A.
Routes shall be marked with uniform ATV/UTV route signs in accordance
with Ch. NR 64.12(7), Wis. Adm. Code. No person may do any of the
following in regard to signs marking City ATV/UTV routes:
(1)
Intentionally remove, damage, deface, move or obstruct any uniform
ATV/UTV or trail sign or standard or intentionally interfere with
the effective operation of any uniform ATV/UTV route or trail sign
or standards if the sign or standard is legally placed by the state,
any municipality or any authorized individual.
(2)
Possess any uniform ATV/UTV route or trail sign or standard of the
type established by the department for the warning, instruction or
information of the public, unless he or she obtained the uniform ATV/UTV
route or trail sign or standard in a lawful manner. Possession of
a uniform ATV/UTV route or trail sign or standard creates a rebuttable
presumption of illegal possession.
B.
The ATV/UTV Club shall be responsible for purchasing, maintaining,
and installing all necessary and required signs.
C.
In addition to the provisions of § 23.33, Wis. Stats.,
the following restrictions are placed on the use of the City ATV/UTV
routes designated by this article:

All ATV/UTV operation shall be confined to the far right side of
the paved surface or confined to the shoulder or unimproved rights-of-way
of the designated routes.
(3)
All ATV/UTV operators shall ride single file.
(4)
All ATV/UTV headlamps and tail lamps must be turned on at all times.
(5)
All UTV operators and passengers must wear seat belts at all times.
(6)
The City of Lancaster routes will be closed from 10:00 p.m. to 6:00
a.m.
(7)
The City of Lancaster may close routes at any time through removal
of all route signage and providing notice to the public.
(8)
The City of Lancaster routes will be closed from November 15th to
March 15.
The enforcement provisions under § 23.33(12), Wis.
Stats., as the same may be amended from time to time, are adopted
by reference as if fully set forth herein.
Penalties as found in § 23.33(13), Wis. Stats., as
the same may be amended from time to time, are adopted by reference
as if fully set forth herein.
