There is hereby established in the Township of Nutley a State Uniform
Construction Code enforcing agency to be known as the Nutley Code
Enforcement Department," consisting of a Construction Official, Building
Subcode Official, Plumbing Subcode Official, Electrical Subcode Official,
Fire Protection Subcode Official and such subcode officials for such
additional subcodes as the Commissioner of the Department of Community
Affairs, State of New Jersey, shall hereafter adopt as part of the
State Uniform Construction Code. The Construction Official shall be
the chief administrator of the Code Enforcement Department. All subcode
officials, their assistant and staff for the purposes of the regulations
and its enforcement are subject to the procedures and policies of
the enforcing agency and are primarily responsible to the Construction
Official.

A central permit office, under the direction and supervision of the
Construction Official, will be located in the Municipal Building,
1 Kennedy Drive, Nutley, New Jersey, to be open during the hours of
8:00 a.m. to 4:00 p.m. on normal business days of the municipality.
The Essex County Board of Appeals, 900 Bloomfield Avenue, Verona,
New Jersey 07044, shall hear any appeal from decisions by the enforcing
agency.
A.
Plan review fee. The fee for plan review shall be 20% of the construction
permit fee and shall be paid before the plans are reviewed. The fee
shall be credited toward the fee for the construction permit but shall
not be refundable in the event a permit is not issued.

Building subcode fee.

Tents, construction trailers, air-supported structures, etc.:

Minor work. As defined in N.J.A.C. 5:23-2.17A(c) 1, 2, 3, 4, 5 and
6 fees for minor construction work shall be computed in accordance
with N.J.A.C. 5:23-4.18(c)(l)vii.

Plumbing subcode fees.

(a)
Grease traps, oil separators, interceptors, refrigeration units,
backflow preventers equipped with test ports (double check valve assembly,
reduced pressure zone and pressure vacuum breaker backflow preventers),
steam boilers, hot water boilers, gas piping/service connection, active
solar systems, sewer pumps, fuel oil piping, vent stacks.

for an above-ground pool or in-ground pool shall include any required
bonding, and associated equipment such as filter pumps, motors, disconnecting
means, switches, required receptacles, and heaters, etc., excepting
panel boards and underwater lighting fixtures.

Move/relocate a structure permit: the fee for the removal of a building
or structure from one lot to another or to a new location on the same
lot shall be $30 per thousand of the sum of the estimated costs for
moving, for new foundations and for the placement in a completed condition
in the new location, provided that the minimum fee shall be $100.

Any fees not included in this fee schedule shall be priced in accordance
with N.J.A.C. 5:23-4.20
No person shall be charged a construction permit surcharge fee
or enforcing agency fee for any construction, reconstruction, alteration
or improvement designed and undertaken solely to promote accessibility
by disabled persons to an existing public or private structure or
any of the facilities contained therein, pursuant to N.J.S.A. 52:27D-126e.
In accordance with N.J.S.A. 52:27D-126c, all public buildings
and board of education buildings shall be exempt from permit fees.
