The accounts of the Township shall be audited by the auditor who shall be appointed, qualified, and compensated in accordance with the provisions of § 520 of the First Class Township Code, as amended, 53 P.S. § 55502, and who shall have the powers and perform the duties provided by the said Code for elected auditors.

The office of elected auditor is hereby abolished.

In accordance with the provisions of the Act of June 24, 1931, P.L. 1206, Article XV, § 1502, 53 P.S. § 56502, as amended, the office of Township Manager for the Township of East Pennsboro, Cumberland County, Pennsylvania, is hereby created.

The Manager shall be appointed for an indefinite term by a majority of all the members of the Board. The Manager shall serve at the pleasure of the Board and may be removed at any time by a majority vote of all its members. At least 30 days before such removal becomes effective, the Board shall furnish the Manager with a written statement setting forth its intention to remove him and the reasons therefor.

The Manager shall be chosen on the basis of his executive and administrative abilities, with special reference to his actual experience in or his knowledge of accepted practices in respect to the duties of his office as herein outlined. The Manager need not be a resident of the Township or of the State of Pennsylvania at the time of his appointment.

Before entering upon his duties, the Manager shall present a bond to the Township with a bonding company as surety, to be approved by the Board, in the sum of $5,000, conditioned for the faithful performance of his duties. The premium shall be paid by the Township.

The salary of the Township Manager shall be fixed from time to time by the Board of Commissioners.

1. 
The Manager shall be the chief administrative officer of the Township and he shall be responsible to the Board for the proper and efficient administration of the affairs of the Township. His powers and duties shall relate to the general management of all Township business not expressly by statute imposed or conferred upon other Township officers.
2. 
Subject to recall by ordinance of the Board, the powers and duties of the Township Manager shall include the following:
A. 
The Manager will supervise the various activities of all departments except that of the Police Department.
B. 
The Manager shall submit all recommendations and applications for employment to the Board for its decision to fill vacancies or to add new employees.
C. 
The Manager, with the assistance of the Commissioner on Finance or Finance Committee, shall prepare and submit to the Board before the close of the calendar year, or on such alternate date as the Board shall determine, a budget for the next calendar year and an explanatory budget message. In preparing the budget the Manager shall obtain from the head of each department, agency, board or officer, estimates of revenue and expenditures and other supporting data. The Manager shall review such estimates and may revise them before submitting the budget to the Board.
D. 
The Manager shall be responsible for the administration of the budget after the adoption by the Board.
E. 
The Manager shall hold such other municipal offices as the Board may from time to time direct but he cannot under any circumstances become the head of any municipal department.
F. 
The Manager shall attend all meetings of the Board and its committees with the right to take part in the discussion and he shall receive notice of all special meetings of the Board or of its committees.
G. 
The Manager shall notify all members of all boards, commissions, committees, authorities, etc., of the Township of all regular and special meetings.
H. 
The Manager shall keep the Board informed as to the conduct of Township affairs; submit periodic reports on the condition of the Township finances and such other reports as the Board requests; and make such recommendations to the Board as he deems necessary.
I. 
The Manager shall, with the approval of the President of the Board, prepare the agenda for each meeting of the Board and supply facts pertinent thereto.
J. 
The Manager shall submit to the Board, as soon as possible after the close of the calendar year, a complete report on the financial and administrative activities of the Township for the preceding year.
K. 
The Manager shall see that the provisions of all franchises, leases, permits, and privileges granted by the Township are observed.
L. 
The Manager shall employ, after approval by the Board, experts and consultants to perform work and to advise in connection with any of the functions of the Township.
M. 
The Manager shall attend to the letting of contracts in due form of law and he shall supervise the performance and faithful execution of the same except insofar as such duties are expressly imposed upon some other Township officer by statute.
N. 
The Manager shall see that all monies owed the Township are promptly paid and inform the Board of those that are owed so that Board action can determine the procedure for the security and collection of all the Township's claims.
O. 
The Manager shall be the purchasing officer of the Township and he shall purchase, in accordance with the provisions of the First Class Township Code 53 P.S. § 55101 et seq., all supplies and equipment for the various agencies, boards, departments, and other offices of the Township. He shall keep an account of all purchases and shall, from time to time or when directed by the Board, make a full written report thereof. He shall also issue rules and regulations subject to the approval of the Board governing the requisition and purchasing of all municipal supplies and equipment. The Township Manager is authorized to make purchases for the Township without the approval of the Commissioners up to the limit of competitive bids under the First Class Township Code.
P. 
The Manager shall submit at the request of the Board an itemized inventory of all property of all types and numbers of equipment of the Township and give a fair market value of each.
Q. 
The Manager shall refer to the Board all complaints received by him regarding personnel employed by the Township. The Board shall investigate and dispose of the matter in a proper way.
R. 
The Township Manager shall be responsible and shall have full authority to hire and discharge Township employees not covered by civil service provided the Commissioners shall authorize the total number of employees to be employed by the Township in each municipal department and the Manager shall not hire personnel beyond this number.

Neither the Board nor any of its committees or members thereof shall interfere with the administering of the ordinances or resolutions passed granting authority to the Manager, except for the purpose of inquiry, in which case the Board may call personnel to attend the Board's executive meeting.

If the Manager becomes ill or is absent from the Township for a period of more than two weeks, the Board shall designate the member or members of the staff to perform the duties of the Manager. Should the absence be two weeks or less, the Manager shall designate the staff member or members to perform his duties in his absence. In the event the Manager is unable to designate the staff member or members, then it shall become the duty of the Board.
