The Township recognizes that various federal, state and local laws, regulations and ordinances require as a condition to the granting of permits or other considerations or benefits, that certain tests and inspections be undertaken by, and the subject matter thereof deemed satisfactory to, engineers, architects, surveyors or other qualified persons. The Township further recognizes that these tests and inspections, if conducted by engineers, architects and surveyors, can and do involve a substantial expense to the individual upon whom the obligation to test or inspect is imposed. The Township Commissioners believe that many such tests and inspections, or portions thereof, can be adequately performed at a lesser expense by qualified Township personnel to the satisfaction of all interested parties. Therefore, it is the intention of the Board of Commissioners in adopting this resolution to authorize appropriate Township personnel to conduct any such tests and inspections at the fee set forth herein, when, in the discretion of the appropriate Township representative or employee, such tests and inspections can be performed by Township personnel at a lesser expense, and in a manner both competent and satisfactory to all interested parties.

Appropriate Township personnel are hereby authorized to perform tests and inspections, when, in the discretion of the Township, such tests and inspections can be performed by Township personnel competently and adequately, to the satisfaction of all interested parties, and at a lesser expense to the individual obligated to provide the test or inspection than if the test or inspection is performed by a professional engineer, architect or surveyor.

The tests and inspections which Township personnel are hereby authorized to perform include, but are not necessarily limited to, the following: testing of dry sewer lines, testing of manholes, inspections of surface water drainage and collection systems, inspections pursuant to requests for use and occupancy certificates, inspections of streets, curbing and sidewalks, and other inspections of ongoing construction activity. The Township shall be under no obligation to use its personnel in the performance of any particular test or inspection, and may require that such test or inspection be performed by a registered or professional engineer, architect or surveyor, provided that such requirement is consistent with the federal, state or local law, regulation or ordinance imposing the obligation to provide the test or inspection.

Fees hereunder shall be established from time to time by separate resolution of the Board of Commissioners.
2. 
The Township may withhold approval of applications, permits, or other requested relief or consideration pending payment of the inspection fee imposed hereby, or may bill the individual for whom the test or inspection was performed at some later time. The Township shall have full recourse to any and all legal remedies the use of which is necessary to enforce collection of the inspection fee hereby imposed.

This Part shall not repeal or otherwise affect any other ordinance or resolution establishing or setting forth a test or inspection fee for a specific type of test or inspection mandated thereby, and shall apply only to tests or inspections for which a fee has not otherwise been imposed by ordinance or resolution.
