It shall be unlawful for any owner of townhouses, apartments or multi-family dwelling units to allow accumulation of trash, garbage or refuse to exceed the size and capacity of the dumpsters or sealed trash cans that services said occupancies. At all times the lid and/or cover of the container shall be closed and/or sealed and remain secure so as to prevent unwanted access to the container and cause cardboard, mattresses, bedding, furniture, lumber, scrap iron, tin and other materials from being accumulated around, beside and on top of said dumpster or trash cans in a manner such that it is threat to the public safety and health.

At the discretion of the Code Enforcement Officer and/or Health Officer, all pre-existing commercial and multifamily residential dumpsters which continually pose a nuisance to public safety, sanitation and health may be required to comply by screening said dumpsters with a minimum of a six feet high enclosed solid chain link fence with a locking gate in an effort to control excessive improper dumping of accumulated garbage, trash, rubbish and other waste materials.

No owner or occupant of land shall allow or permit trees, shrubs, or plant growth to impede, obstruct or interfere with safe pedestrian or vehicular passage on any street, sidewalk or alley or with any traffic control device or public street sign. The height of all other tree limbs not deemed an obstruction by the Code Enforcement Officer or his/her designate agent shall conform with § 25-106 of this Code of Ordinances, requiring that all street trees shall have a minimum clearance of nine feet above public walks and 12 feet where they overhang any public street, highway, avenue, or lane.

Any property owner who fails to remove the above referenced obstructions within a thirty-day time period after being properly notified in writing may be accessed by the township for the cost of the entire removal and disposal, in addition to any fines levied for failure to comply.

No owner or occupant of land shall allow accumulated plant materials that are dead, dormant, or so dry as to be readily flammable or combustible on such land that may constitute a fire hazard or other threat to the public safety or health.

No walk, fence, sign or other structure shall be erected or altered, and no hedge, trees, shrubs or other growth shall be maintained or permitted which may cause danger to traffic on a street or public road by obscuring the view.

Any person, firm or corporation who shall violate any provision of this Part, upon conviction thereof, shall be sentenced to pay a fine of not more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 30 days. Each day that a violation of this Part continues shall constitute a separate offense.
