For any regulated activities not eligible for the exemptions provided in § 23-302, the final approval of subdivision and/or land development plans, the issuance of any building or occupancy permit, or the commencement of any land disturbance activity, may not proceed until the applicant has received written approval of a SWM site plan and report from the Borough.

1. 
SWM Site Plan Requirements. The SWM site plan shall be presented on one or more sheets of professionally prepared drawings which nearly present a plan of the project, with appropriate details, sectional and profile views, at a scale necessary to accurately and clearly demonstrate compliance with this chapter and to show the elements required below. The drawings shall be of sufficient detail to enable construction of proposed BMPs and stormwater conveyance facilities. The SWM site plan shall show the entire area proposed for development and immediate surroundings, and include the following:
A. 
Proposed name or identifying title of the project.
B. 
Name and address of the landowner.
C. 
Name and address of the project developer.
D. 
Name and address of plan preparer.
E. 
Plan date and revision date. All revised submittals to the Borough shall bear a new revision date.
F. 
North arrow and graphic scale.
G. 
Project location map at a scale of one inch equals 2,000 feet. Use of a 7.5 minute USGS topographic map is preferred.
H. 
Property boundaries.
I. 
Existing and proposed contours, typically at a contour interval of one or two feet.
J. 
Elevation benchmark identified.
K. 
Soil types and boundaries as shown on NRCS mapping.
L. 
Location of soils and/or infiltration testing.
M. 
One-hundred-year flood boundaries. Where development is proposed within a one-hundred-year floodplain, the one-hundred-year flood elevation shall also be noted, and plan elevations shall utilize the same benchmark elevation as the Federal Emergency Management Agency (FEMA) Flood Insurance Study (FIS).
N. 
Proposed area of disturbance, with the total area noted in acres.
O. 
Existing and proposed ground cover, structures, and other land use features.
P. 
Existing and proposed water wells, Zone 1 wellhead protection areas for public water system sources of supply, and on-lot wastewater facilities.
Q. 
Existing and proposed drainageways. Pipe or channel sizes, materials, and invert elevations shall be noted.
R. 
Existing and proposed BMPs.
S. 
A signature block for Borough approval which states as follows: "The Borough of Edinboro has reviewed this stormwater management site plan and accompanying report and on this date certifies that the stormwater management site plan and report are in substantial conformance with the requirements of this chapter."
2. 
SWM Report Requirements. The SWM report shall consist of a written narrative and those calculations, exhibits, and appendices necessary to clearly demonstrate compliance with this chapter and to include the elements required below:
A. 
Proposed name or identifying title of the project.
B. 
Name and address of the landowner.
C. 
Name and address of the project developer.
D. 
Name and address of plan preparer.
E. 
Report date and revision date. All revised submittals to the Borough shall bear a new revision date.
F. 
Narrative description of the property, existing land use and ground cover.
G. 
Narrative description of the proposed project, including area of disturbance in acres.
H. 
Listing of permits required for the project.
I. 
Description of soil types and identification of applicable hydrologic soil groups.
J. 
Description and calculations associated with soils testing and/or infiltration testing.
K. 
Identification of surface waters which may receive runoff within or from the project site and their classification under 25 Pa. Code, Chapter 93 (relating to water quality standards).
L. 
A written description of the type, function, and location of existing and proposed non-structural and structural BMPs.
M. 
Runoff calculations to document compliance with volume control and rate control requirements. The narrative shall describe the assumptions, criteria, and methodology used. A summary table shall be provided of the net change in volume and rate of stormwater from pre-development to post-development hydrology for both the entire Project Site and each drainage area. The runoff calculations shall include the following at a minimum:
(1) 
Delineation of pre-development drainage areas.
(2) 
Calculation of pre-development times of concentration with flow paths identified for each drainage area.
(3) 
Hydrologic calculations for each pre-development drainage area, with routing calculations as necessary to combine flows from various drainage areas.
(4) 
Delineation of post-development drainage areas.
(5) 
Calculation of post-development times of concentration with flow paths identified for each drainage area.
(6) 
Hydrologic calculations for each post-development drainage area, with routing calculations as necessary to combine flows from various drainage areas.
(7) 
Routing calculations, including a stage-area-discharge table, through each BMP providing significant storage.
N. 
Calculations comparing the full flow capacity of proposed pipes and channels to the design flow through them.
O. 
A description of plans for site restoration and permanent stabilization.
P. 
A sequence of project implementation and BMP installation in relation to earth disturbance activities of the project site and a schedule of inspections for critical stages of BMP installation. Estimated dates for implementation shall also be provided.
Q. 
A written maintenance plan including the duties to be performed, frequency of maintenance, and responsibility for maintenance and long-term ownership.
R. 
Listing and description of easements to be established.
S. 
Description of the effect of stormwater management on existing and proposed wells on site or where the development occurs within the wellhead protection area of a public water supply well.

1. 
The Borough shall require receipt of a complete SWM site plan and report as specified in this chapter. The Borough shall review the SWM site plan and report for consistency with the purposes, requirements, and intent of this chapter. The Borough shall not approve any SWM site plan and report that is deficient in meeting the requirements of this chapter. At its sole discretion and in accordance with this Part, when a SWM site plan and report is found to be deficient, the Borough may disapprove the submission and require a resubmission, or in the case of minor deficiencies, the Borough may accept submission of modifications.

Initially, two copies of the SWM site plan and report shall be submitted to the Borough Enforcement Officer. The Borough Enforcement Officer shall keep one copy and forward one copy to the Borough Engineer for review. After all reviews and revisions have been completed, the applicant shall submit four final copies to the Borough Enforcement Officer. Upon final approval and Borough signatures, one copy will be forwarded to the Borough Engineer, one will be kept on file with the Borough, one copy will be provided to the applicant, and the fourth copy will be provided to the applicant for recording purposes. Additional copies shall be submitted as requested by the Borough.
3. 
The SWM site plan and report shall be accompanied by such fees as may be required, and/or by a properly executed review fee reimbursement agreement if necessary.
4. 
If the applicant is also required to obtain approval of a subdivision or land development plan related to the regulated activities, then Borough review and approval or disapproval of the SWM site plan and report shall follow the time frame established for review and approval under the Borough of Edinboro Subdivision and Land Development Ordinance [Chapter 22].
5. 
If the applicant is not required to obtain approval of a subdivision or land development plan related to the regulated activities, then within 45 calendar days of the date of submission the Borough Council shall act to approve or disapprove of the plan and give the applicant written notice of the action.
6. 
When a SWM site plan and report is disapproved, the Borough shall provide the applicant the reason(s) for disapproval with references to the requirements of this chapter.
7. 
The Borough shall not approve any subdivision or land development plan, or issue any building permit, for any regulated activity if the SWM site plan and report has not been approved, or if the required permits from PADEP for land disturbance associated with the regulated activity have not been obtained.

A modification to a submitted SWM site plan and report for a project site that involves a change in stormwater management facilities or techniques, or that involves the relocation or redesign of stormwater management facilities, or that is necessary because soil or other conditions are not as stated on the SWM site plan and report as determined by the Borough, shall require a resubmission of the SWM site plan and report in accordance with this chapter.

A disapproved SWM site plan and report may be resubmitted with the revisions addressing the Borough's concerns documented in writing, to the Borough Enforcement Officer in accordance with this chapter. A Borough review fee may be required by the Borough for resubmission of a disapproved SWM site plan and report.

Borough approval of a SWM site plan and report authorizes the regulated activities documented in the SWM site plan and report for a maximum term of five years following the date of approval. The Borough may specify a term shorter than five years in the approval for any specific SWM site plan and report. If stormwater management facilities included in the approved SWM site plan and report have not been constructed, or if a record drawing of these facilities has not been submitted within this time, then the Borough may consider the SWM site plan and report disapproved and may revoke any and all permits or approvals.

The applicant shall be responsible for providing record drawings of all stormwater BMPs included in the approved SWM site plan and report. The record drawing and an explanation of any discrepancies with the approved SWM site plan and report shall be submitted to the Enforcement Officer as a prerequisite for the release of the guarantee or issuance of an occupancy permit.
2. 
The record drawing shall include a certification of completion signed by a qualified professional verifying that all permanent stormwater BMPs have been constructed according to the approved SWM site plan and report.
A. 
Record drawings shall show all approved revisions and elevations and inverts to all manholes, inlets, pipes and stormwater management facilities.
B. 
Record drawings shall include a comparison of the constructed stage-storage (volume vs. elevation) of all above ground and below ground storage facilities to the approved design.
3. 
After receipt of the record drawing and certification of completion by the Borough, the Borough, the Borough Engineer and/or Borough designee may conduct a final inspection. Such final inspection may include survey measurements of the constructed stormwater management facilities to ensure conformance with the approved SWM site plan and report. The costs for such final inspection and surveys shall be reimbursed by the applicant per the provisions of § 23-1102 of this chapter.

Where a SWM site plan and report relates to application for subdivision or land development made under the Borough of Edinboro Subdivision and Land Development Ordinance [Chapter 22] or planned residential development regulations, then appeals from the administration or determinations of the provisions of this chapter shall be heard by, and final adjudications shall be rendered by, Borough Council.
2. 
Where a SWM site plan and report does not relate to application for subdivision or land development made under the Borough of Edinboro Subdivision and Land Development Ordinance [Chapter 22] or planned residential development regulations, then appeals from the administration or determinations of the provisions of this chapter shall be heard by, and final adjudications shall be rendered by, the Zoning Hearing Board per the provisions of the Pennsylvania Municipalities Planning Code, 53 P.S. § 10101 et seq.
3. 
All appeals from final decisions in regards to this chapter rendered by Borough Council or the Zoning Hearing Board as applicable shall be taken to the Erie County Court of Common Pleas and shall be filed within 30 days after the decision.
