In the event that any curb or sidewalk shall become broken or dilapidated, the property owner of such curb or sidewalk shall repair and construct such curb or sidewalk.
The Borough of Lavallette is hereby authorized to repair or reconstruct broken or dilapidated curbs or sidewalks, either by its own employees or by contract and charge the cost thereof to the owners should the owners not repair any damaged curbs or sidewalks within 90 days of receiving notice from the Borough's Code Enforcement Officer of a broken or dilapidated curb or sidewalk. Upon completion of such repair or reconstruction, the owner shall be notified by regular mail of the cost thereof. If the cost of such repair or reconstruction of the street curb is not paid within 30 days of receipt of such notification, the cost there shall be certified by the Borough Clerk to the Tax Collector of this Municipality, who shall include the cost in the next tax bill to the property owner.

Any person, firm or corporation that shall be convicted of a violation of a provision of this article shall, upon conviction whereof by any court authorized by law to hear and determine the matter, be subject to a fine of no less than $100 and no more than $1,000, imprisonment not to exceed 90 days or community service of not more than 90 days, or any combination of fine, imprisonment and community service, as such court in its discretion may impose. Each day that such violation exists shall constitute a separate offense.
The street curb adjacent to all property in this municipality shall be periodically examined in order to ascertain whether it is broken or dilapidated, and, if so, a record will be made of the condition thereof.
A. 
All construction, reconstruction or repairs of sidewalks, driveway aprons or curbs shall be performed in accordance with the construction details established by the Municipal Engineer. A copy of the construction details shall be maintained on file in the office of the Municipal Clerk and the Construction Official.
B. 
This requirement shall not pertain to sidewalks abutting the municipal oceanfront beach, nor shall it apply to the most easterly 50 feet of the easterly terminus of streets running to the Atlantic Ocean.
