All words, terms and phrases, when used in this article, shall have the meanings ascribed to them in the Recodified Tax Increment Financing Act (Act 57 of 2018).

Editor's Note: Nothing in this article shall be interpreted as a discontinuation of the Village Downtown Development Authority. The Downtown Development Authority shall be and remain constituted in accordance with and shall have all of the powers and duties set forth in Act 57 of 2018, as amended from time to time and in this article.

The Downtown Development Authority is hereby created and established pursuant to the terms and provisions of Act No. 57 of the Public Acts of Michigan of 2018, which act is adopted by reference.[1]

Reference in Act 57 of 2018 to the term "chief elected officer" or "chief executive officer" shall mean the President of the Village.
Reference in Act 57 of 2018 to the term "chief administrative officer" shall mean the Village Manager.
Reference in Act 57 of 2018 to the term "governing body of a municipality" shall mean the Village Council.
Reference in Act 57 of 2018 to the term "municipality" shall mean the Village of Vicksburg.

The map of the boundaries of the Downtown District within which the Downtown Development Authority shall exercise its powers is on file at the office of the Village Manager. The boundaries of the Downtown District, within which the Downtown Development Authority shall exercise its powers, shall be amended as follows:
Beginning at the intersection of the east line of Section 13, T. 4 S. , R. 11 W., Schoolcraft Township, Kalamazoo County, Michigan, said line also being the west line of Section 18, T. 4 S., R. 10 W., Brady Township, Kalamazoo County, Michigan, with the southerly shore of Sunset Lake; thence southwesterly along said shore to the westerly right-of-way line of Kalamazoo Avenue as extended north; thence south thereon to the south right-of-way line of E. The Board, which is the governing body of the Village Downtown Development Authority, may have a director, who shall be appointed by the Village President upon approval of the Village Council and who shall serve at the pleasure of the Board. A bond shall furnished by or on behalf of the Director, as determined by resolution of the Village Council.
The Board's Director shall render to the Board and to the Village Council regular reports covering the activities and financial condition of the Downtown Development Authority, which reports shall be made at least quarterly during the first year of operation of the Downtown Development Authority, and at least annually every year thereafter, unless more frequent reports are requested by the Board or Village Council.
The Board, when requiring legal counsel, may seek the services available from the Village Attorney or any other attorney, subject to approval of the Village President.

Pursuant to the Michigan Planning Enabling Act, the Planning Commission shall concurrently serve as the board of the Village of Vicksburg Downtown Development Authority and shall have all authority and duties of the DDA Board as set forth in Act 57 of 2018.
