It shall be unlawful for any person not licensed under the PA Medical Marijuana Act[1] to own, possess, grow, process, sell, or dispense any form of medical marijuana unless that person is licensed by the Commonwealth of Pennsylvania, Department of Health, and owns, possesses, grows, processes, sells or dispenses the marijuana in accordance with all licensing and regulations of the PA Department of Health.

Any person who owns, possesses, grows, processes, sells, or dispenses any form of medical marijuana not in accordance with the rules and regulations of the PA Department of Health and without a valid license for doing so shall be subject to all of the penalties of the Pennsylvania Crimes Code,[1] as well as a civil fine of not less than $100 nor more than $1,000 for each offense. Each day constitutes a separate offense.
