The provisions of any local law in conflict with any provisions
of this chapter are hereby repealed.
A.
If any provisions of this chapter are inconsistent
with any existing regulations, rules or ordinances of the Town of
Webster, the provisions of this chapter shall supersede any inconsistent
rules, regulations or ordinances. Any such regulations, etc., which
are not inconsistent with this chapter shall continue in full force
and effect.
B.
If any provisions of this chapter are inconsistent
or in conflict with or are less restrictive than the regulations of
the Monroe County Health Department, the New York State Health Department,
the New York State Department of Environmental Conservation, or the
Environmental Protection Agency (or any other agency having jurisdiction
over the Town of Webster sanitary sewer system), the regulations of
the Monroe County Health Department, New York State Health Department,
New York State Department of Environmental Conservation of the Environmental
Protection Agency shall control.
Each provision of this chapter is severable from the others,
so that if any provision is held to be illegal or invalid for any
reason whatsoever, such illegal or invalid provisions shall be severed
from this chapter, which shall nonetheless remain in full force and
effect.
A.
The standards herein are based
upon available scientific and engineering considerations which may
be advised as experience indicates. However, damages may nevertheless
still occur within the stated limits. This Sewer Use Law shall not
create liability on the Town of Webster or any officer or employee
thereof for damages that result from compliance or noncompliance with
the law or any administrative decision lawfully made or not made thereunder.
B.
Further, compliance or noncompliance
with this Sewer Use Law is not intended nor shall it be construed
to preclude a separate civil action for any actual damages caused
by persons or property injured by those persons emitting such chemicals
or offensive materials which result in such damages.
