All foreclosed real property and vacant property is hereby declared
to be a public nuisance, the abatement of which, pursuant to the police
power of the Township, is hereby declared to be necessary for the
health, welfare, and safety of the residents of the Township.
Adherence to this chapter does not relieve any person, legal
entity, or agent from any other obligations set forth in any applicable
code(s) that may apply to the property. Upon sale or transfer of title
to the property, the new owner shall be responsible for remedying
all existing violations of the applicable code(s) and the new owner
shall be responsible for meeting with the Township's Enforcement
Officer within 45 days for a final inspection and report.
Any person, firm, or corporation who shall violate any provision
of this chapter, upon conviction thereof in an action brought before
a district justice in the manner provided for the enforcement of summary
offenses under the Pennsylvania Rules of Criminal Procedure, shall
be sentenced to pay a fine of not less than $100 nor more than $1,000
for each separate offense and, in default of the payment of such fine,
may be sentenced to imprisonment for 90 days, or to the extent allowed
by law for the punishment of summary offenses. Each day that a violation
of this chapter continues and each section of the chapter that has
been violated shall constitute a separate offense, and penalties shall
be cumulative.
