[Amended at time of adoption of Code (see Ch. 1, General Provisions, Art. III)]
Pursuant to the authority vested in the Indian Head Town Council by § 5-206 of the Local Government Article of the Annotated Code of Maryland, and Section C6-2 of the Charter of the Town of Indian Head, there is hereby established a personnel system for the Town. This chapter shall be known as the "Personnel Ordinance." It is hereby declared that this chapter is enacted to establish a personnel system for all present and future employees with the exception of those positions which may be exempt by this chapter. This personnel system shall provide the means to recruit, select, develop and maintain an effective and responsive work force which will meet the social, economic and service requirements of the citizens of Indian Head. All personnel actions shall be made without regard to race, sex, marital status, color, religion, national origin, other protected status or classification or political affiliation.
As used in this chapter, the following terms shall have the meanings indicated:
ADMINISTRATIVE SERVICE
Includes those employees of the Town engaged primarily in office and clerical functions as identified by the personnel director.
CAREER SERVICE
Those positions in the classified service of the Town that are not identified in § 117-3B as being in the exempt service.
CLASSIFIED SERVICE
Includes all employees in the service of the Town, including introductory employees, with the exception of those positions identified as being in the exempt service by § 117-3B of this chapter.
EXEMPT SERVICE
Those employees who are identified by § 117-3B of this chapter as being in the exempt service.
INTRODUCTORY PERIOD
The first six-month, or extended, period of a new employee's employment in the classified service.
LAYOFF
The temporary or permanent discharge of an employee which is usually the result of a lack of municipal funds to support the particular position on a short-term or permanent basis, government restructuring or some other administrative reason.
PART-TIME EMPLOYEE
An employee whose regularly scheduled hours of work are less than 32.5 hours per week.
PERSONNEL BOARD
A Board, consisting of the Indian Head Town Council, whose responsibility it is to address personnel matters on appeal as provided in this chapter, including grievances or disputes relating to the application, meaning or interpretation of this chapter, and actions resulting in the suspension, demotion or discharge of an employee in the career service.
QUALIFYING PERIOD
The working test period served by promotional appointees and employees transferred to a class dissimilar to the one previously held.
TEMPORARY OR SEASONAL EMPLOYEE
An employee whose position comprises duties which occur, terminate, and recur seasonally, intermittently or according to the needs of a department and whose projected date of termination of employment is less than one year from the date of hire.
TOWN
The Town of Indian Head.
TOWN COUNCIL
The Indian Head Town Council.
TOWN MANAGER
The chief executive and administrative officer of the Town.
A. 
All employee positions of the Town are divided into the exempt service and the career service.
B. 
The exempt service shall include the following:
(1) 
Town Manager.
(2) 
Town Clerk.
(3) 
Finance Officer.
(4) 
Part-time, temporary or seasonal positions.
(5) 
Employees providing services under a written employment agreement that expressly provides that the employee is not governed by or subject to this chapter.
C. 
The career service shall include all other employee positions in the Town that are not specifically placed in the exempt service by Subsection B of this section.
D. 
The Town Council, the Town Attorney and persons holding volunteer or other unpaid positions with the Town are not employees of the Town and are not included within the Town's personnel system.
The Town Manager shall be responsible for the following:
A. 
The Town Manager shall act as the personnel director until such time as such a position is created by the Town Council and appointment made thereto by the Town Manager.
B. 
Recommendations to the Town Council with regard to the classification of positions, job specifications and compensation therefor; and recommendations relative to the adoption of and amendment to all rules and regulations pertaining to the personnel system, the administration of the classification system and pay plan and rates of compensation, including the approval of performance pay increases; inclusion of said recommendations each year in the budget recommendations submitted to the Town Council.
C. 
Approval of performance pay increases within the budget parameters as established by the Town Council.
D. 
Establishing qualifications for all employment positions.
E. 
The appointment, transfer, promotion, demotion, suspension, dismissal, or any such change in an employee's status.
F. 
Maintenance of such personnel records as may be required.
G. 
Administration of the personnel system and regulations.
By ordinance, the Council shall adopt and amend all rules and regulations pertaining to the personnel system and classification plan pursuant to Section C6-2 of the Indian Head Town Charter, including the establishment or modification of compensation schedules and compensation for the exempt and classified personnel of the Town with the adoption thereof in the annual budget for the Town.
