It is hereby declared to be the policy of the Village of Great Neck
Estates to maintain a reasonable degree of purity of its air resources, consistent
with the public health, welfare and comfort of the residents of the Village
and the protection of property and other resources, and to that end to require
the use of all available practical and reasonable methods for preventing and
controlling air pollution in the Village atmosphere.
It is the intent and purpose of this chapter to safeguard the air resources
of the Village of Great Neck Estates from pollution by controlling or abating
air pollution existing when this chapter is enacted and preventing new air
pollution under a program which is consistent with the above-stated declaration
of policy.
As used in this chapter, the following terms shall have the meanings
indicated:
The presence in the atmosphere of one or more air contaminants in
quantities, of characteristics and of a duration which are injurious to human,
plant or animal life or to business or property or which interfere with the
comfortable enjoyment of life, property, health, repose, safety or welfare
of persons.
Open air existing in all space outside of buildings, stacks or exterior
ducts.
Any individual, public or private corporation, political subdivision,
agency, board, department or bureau of the state or any political subdivision
of the state, municipal corporation, partnership, association, firm, trust,
organization, estate or any other legal entity whatsoever which is recognized
by law as the subject of rights and duties, or any officer, agent or employee
of any of the foregoing.
Equipment designed to burn garbage, rubbish and other wastes.

Commencing immediately, no person shall use, or permit
the use or operation of, refuse burning equipment or incinerators for the
destruction of refuse without first obtaining an operating certificate issued
by the Commissioner of Health of the Nassau County Department of Health.
B.Â
Commencing immediately, no person shall cause or permit
the installation or construction of any refuse burning equipment or incinerator
for the destruction of refuse in any building or structure being erected or
constructed within the Village.
