The following regulations are hereby adopted to apply to organized playgroups of children using the Village park and pool.
Playgroups shall be limited to children who are residents of the Village and entitled to use the park and pool. Membership in a group does not permit a child to use the park and pool unless he/she is otherwise entitled to do so.
Supervisors and assistant supervisors need not be residents of the Village, but, unless they are residents, they shall not be entitled to the privileges of the park and pool except in the course of their duties.
Each supervisor and assistant supervisor, before commencing his/her duties, must apply for and obtain a license from the Board of Trustees, or its representative designated for the purpose, and must pay the required license fee.
Such license is a personal privilege and is not assignable, and no one is entitled to a license as a matter of right. It will be granted only to such persons as the Board of Trustees may deem qualified by age, character and experience. The Board of Trustees may limit the number of such licenses to be issued or the number of such licenses outstanding at any one time. The determination of the Board of Trustees shall be final and conclusive.
An application for a license must be made in writing, signed by the applicant and filed at the Village office. It must state the applicant's name, residence, age, experience, qualifications and such other information as the Board may require. In the case of applicants who have not previously had a license, character references must be supplied. The applicant must pay, upon filing his/her application, a sum as set forth in Chapter 109, Fees, by check to the order of the Village of Great Neck Estates. Each license will expire on December 31 of the year for which it is issued, and a new application must be filed and a further fee paid for each succeeding year.
Each supervisor, before receiving a license, must file with the Village certificates of insurance, in a form approved by the Mayor, and proof of the payment of the premium therefor, covering worker's compensation and public liability. The public liability insurance shall have $200,000/$500,000 limits and shall include a provision that the insurer will defend, indemnify and save harmless the Village of Great Neck Estates, its officers, agents and employees from any claims, judgments or damages occurring in the course of or arising out of the use of the park and pool by the supervisor, his/her assistant supervisors and the members of his/her group.
Any license may be revoked at any time without notice by the Board of Trustees, which need not assign any reason therefor. Any license may be suspended at any time by the Mayor or Acting Mayor or the Village Park Commissioner until the next meeting of the Board of Trustees, which may reinstate the license, continue the suspension or revoke the license. In case of the suspension or revocation of a license, no refund will be made of the license fee or any part thereof.
Groups and the members thereof are not granted the exclusive use of any part of the park or pool at any time. They must not interfere with the use and enjoyment of the park and pool by other children and adults entitled thereto.
Except for a short period during assembly time in the morning and during lunch or the immediately succeeding rest period, the total number of children of all groups using the park and pool area at any one time shall be limited to 150 children, of whom not more than 100 shall be in the park area, not more than 12 shall be in the kiddie pool area and not more than 40 shall be in the pool area at any one time. The Village official in charge of the park or pool may permit a larger number in the park or pool area if a small number of persons are using the park or pool at the time, but he/she is not required to do so, and his/her determination in the matter shall be final.
Groups are not permitted to use the park and pool on Sundays or holidays. On Saturdays, they are not permitted to use the pool after 11:00 a.m. or the park after 12:00 noon. On other weekdays, they are not permitted to use the pool between 12:30 p.m. and 2:00 p.m.
At the opening of the season, each supervisor must file in the Village Office a complete roster, in writing, of the names and residences of each assistant and each member of his/her group and shall notify the Village Office, in writing, each week of any changes that may occur.
Supervisors or assistant supervisors must at all times remain in personal charge of their groups. Supervisors will be held responsible for the conduct and activities of their assistants and the children of the group. Supervisors, assistant supervisors and children must comply with all of the park and pool regulations and must obey the orders and directions of the Village representatives in charge of the park and the pool.
These regulations may be modified or amended at any time and from time to time, and all licenses are issued subject to such possible modification or amendment.
