A. 
Purpose. The Village owns and has set aside a portion of its property bordering on Little Neck Bay to be preserved in its natural state and used for the purpose of nature trails. It is necessary, in order to preserve that property for its intended purposes, to limit the extent and frequency of use of that property by individuals and groups. Excessive use of the property would be detrimental to its environmental characteristics and would be likely to cause permanent and irreparable harm to the ecology of the area.
B. 
Terms and conditions required for usage. Use of the Village's property bordering on Little Neck Bay which is being preserved in its natural state shall be permitted only by groups of more than three persons and only upon the following terms and conditions:
(1) 
Any group of three or more individuals wishing to make use of the nature trails shall make written application for a permit to the Environmental Commissioner at least 10 days before the intended date of use; provided, however, that family groups of Great Neck Estates residents need not obtain a permit.
(2) 
The Environmental Commissioner may issue a permit only to a group which is composed, in whole or in part, of persons who are residents of the Village of Great Neck Estates, students or faculty of the public schools of the Great Neck School District or members of bona fide organizations dedicated to the improvement and preservation of the environment.
(3) 
Any applicant for a permit shall state in the application the number of persons who request permission to use the property, the date of the proposed visit or visits, the hours and duration of the proposed visit or visits, the qualifications of the person, persons or group requesting the permit and the purpose of the proposed visit.
(4) 
The Environmental Commissioner may, in his/her or her sole discretion, decline to issue a permit for a requested visit on the ground that frequency of visits already scheduled or made to the premises is becoming or has become excessive and that additional visits on the requested dates would be detrimental to the natural characteristics and quality of the area. Such a determination may be made regardless of whether the applicant or applicants would otherwise be entitled to a permit.
(5) 
Any person or persons granted a permit to visit the property shall comply in all respects with any and all regulations promulgated by the Environmental Commissioner for the purposes of preserving the characteristics of the property.
(6) 
Any person or persons aggrieved by any determination of the Environmental Commissioner with respect to issuance or denial of a permit may appeal that determination in writing to the Board of Trustees, which will endeavor to act upon the same within 30 days after receipt. Unless the Board of Trustees shall otherwise direct, the determination of the Environmental Commissioner shall remain in effect during the pendency of any such appeal.
